HUNTER -- read once and referred to the Committee on Economic Development AN ACT to extend permits and licenses issued for the sale of alcoholic beverages at the 2020 New York state fair to the 2021 New York state fair THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the state liquor authority shall extend all temporary permits for the sale of alcoholic beverages at the 2020 New York state fair issued pursuant to section 97-b of the alcoholic beverage control law, and shall extend all licenses issued pursuant to sections 55, 64, 64-a, 64-c, 64-d, 81 and 81-a of the alcoholic beverage control law for a premises located upon the New York state fairgrounds, through December 31, 2021. Such extension shall be given at no cost to the licensee and no late fees shall be charged to the licensee for such extension. § 2. For purposes of this act, the "New York state fair" and "New York state fairgrounds" shall have the same meaning and purpose as in article 2-A of the agriculture and markets law. § 3. HUNTER -- read once and referred to the Committee on Economic Development -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT in relation to providing a credit for fees paid for permits and licenses issued for the sale of alcoholic beverages at the 2020 New York state fair; and providing for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the state liquor authority is authorized to grant a one-time license credit to any on-premises retail licensee or any manufacturing licensee with on-premises retail privileges for license or permit fees paid in calendar year 2020 to the state liquor authority solely to sell alcohol- ic beverages on the premises of the New York State Fairgrounds during 2020 or at the 2020 New York State Fair. Such one-time credit shall only be authorized to apply to permit or license fees related to renewals or applications to sell alcoholic beverages on the premises of the New York State Fairgrounds or New York State Fair. Such credits shall be given at no cost to the licensee and no late fees shall be charged to the licen- see for such credit; however, if requested by the state liquor authori- ty, such licensee shall still be required to submit any forms or infor- mation to the state liquor authority to receive such credit to sell alcoholic beverages on the premises of the New York State Fairgrounds or the New York State Fair. However, no credit shall be issued or applied pursuant to this section if such licensee is able to claim a credit for such fees pursuant to any other applicable provision of law. § 2. For purposes of this act, the "New York state fair" and "New York state fairgrounds" shall have the same meaning and purpose as in article 2-A of the agriculture and markets law. § 3. This act shall take effect immediately and shall expire and be deemed repealed one year after such effective date. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
