 AN  ACT  to  amend  the mental hygiene law, in relation to requiring the
   installation of surveillance cameras with sound capability  in  public
   common  areas of certain residential facilities, community residences,
   and residential and day schools and programs
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The mental hygiene law is amended by adding a new section
 16.24 to read as follows:
 § 16.24 SURVEILLANCE CAMERAS.
   (A)   THE DEPARTMENT SHALL INSTALL  SURVEILLANCE  CAMERAS  WITH  SOUND
 CAPABILITY  IN  THE  PUBLIC  COMMON AREAS IN ALL RESIDENTIAL FACILITIES,
 COMMUNITY RESIDENCES, AND RESIDENTIAL AND DAY SCHOOLS AND PROGRAMS  THAT
 PROVIDE SERVICES FOR INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES AND ARE
 CERTIFIED,  FUNDED,  OPERATED  OR SUBJECT TO LICENSURE BY THE OFFICE FOR
 PEOPLE WITH DEVELOPMENTAL DISABILITIES.
   (B) AS USED IN THIS SECTION, "PUBLIC COMMON AREAS"  INCLUDE,  BUT  NOT
 LIMITED  TO,  COMMON  LIVING  AREAS, DINING AREAS, HALLWAYS, CLASSROOMS,
 LOBBIES AND TIME-OUT ROOMS, BUT EXCLUDED PUBLIC RESTROOMS.
   (C) ANY PROVIDER THAT  FAILS  TO  IMPLEMENT  THE  PROVISIONS  OF  THIS
 SECTION  MAY  BE SUBJECT TO A FINE OF UP TO ONE THOUSAND DOLLARS PER DAY
 OF NONCOMPLIANCE.
   § 2. This act shall take effect one year after it shall have become  a
 law. Effective immediately, the addition, amendment and/or repeal of any
 rule  or  regulation necessary for the implementation of this act on its
 effective date are authorized to be made and completed on or before such
 date.
