AN ACT authorizing the city of Schenectady to alienate certain parcels
of land used as parkland and to provide other parcels of land to
replace such parkland
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subject to the provisions of this act, the city of Schenec-
tady, Schenectady county, acting by and through its governing body, is
hereby authorized to discontinue the parkland and alienate such lands
more particularly described in section three of this act, for the
purpose of relocating Stockade Historic District structures at high risk
from flooding, and upon such other terms and conditions as determined by
the governing body of the city of Schenectady.
§ 2. The authorization contained in section one of this act shall take
effect only upon the condition that the city of Schenectady shall dedi-
cate an amount equal to or greater than the fair market value of the
waterfront parkland being discontinued towards the acquisition of new
waterfront parkland and/or towards capital improvements to existing
waterfront parkland and recreational facilities.
§ 3. The parklands authorized by section one of this act to be discon-
tinued as parkland are described as follows: All that certain piece or
parcel of land located, situate and lying on the northerly side of Front
Street in the City of Schenectady, County of Schenectady, State of New
York and being bounded and described as follows:
BEGINNING at a point on the northerly street boundary of Front Street
at its intersection with the property division line between lands now or
formerly of City of Schenectady as described in Book 763 Of Deeds at
page 300 on the East and lands now or formerly of Francis M. McGovern,
Sr. as described in book 1813 of deeds at page 730 on the West.

THENCE North 29 Degrees 57' 32" West, along said property division
line, a distance of 290.02 feet to a point at its intersection with the
property division line between said lands of City of Schenectady on the
South and lands now or formerly of the Trustees of Union College in the
County of Schenectady and State of New York as described in Book 1525 of
Deeds at page 98 on the North.
THENCE running along said property division line the following seven
courses and distances:
North 74 Degrees 13' 21" East, a distance of 54.63 feet to a point;
North 15 Degrees 50' 17" West, a distance of 82.61 feet to a point;
North 73 Degrees 45' 08" West, a distance of 38.52 feet to a point;
North 40 Degrees 48' 17" West, a distance of 57.65 feet to a point;
North 11 Degrees 30' 05" West, a distance of 29.56 feet to a point;
North 61 Degrees 16' 47" East, a distance of 57.54 feet to a point;
and
South 73 Degrees 48' 38" East, a distance of 113.78 feet to a point at
its intersection with the property division line between said lands of
City of Schenectady on the west and lands now or formerly of cost corpo-
ration as described in book 1566 of deeds at page 469 on the East.
THENCE South 16 Degrees 16' 07" East, along said property division
line, a distance of 418.26 feet to a point on the said northerly street
boundary of Front Street.
THENCE South 74 Degrees 00' 31" West, a distance of 84.75 feet to the
point or place of beginning.
Containing 54,611 square feet or 1.25 acres of land.
§ 4. In the event that the city of Schenectady received any funding
support or assistance from the federal government for the purchase,
maintenance or improvement of the parklands set forth in section three
of this act, the discontinuance and alienation of such parkland author-
ized by the provisions of this act shall not occur until the city of
Schenectady has complied with any federal requirements pertaining to the
alienation or conversion of such parklands, including satisfying the
secretary of the interior that the alienation or conversion complies
with all conditions which the secretary of the interior deems necessary
to assure the substitution of other lands shall be equivalent in fair
market value and usefulness to the lands being alienated or converted.
§ 5. This act shall take effect immediately.
