 AN ACT to amend the social services law, in  relation  to  coverage  for
   assistance  for  remotely  connected insulin pens for certain patients
   with diabetes
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision 2 of section 365-a of the social services law
 is amended by adding a new paragraph (ii) to read as follows:
   (II) REMOTELY CONNECTED INSULIN PENS FOR PATIENTS WITH  DIABETES  THAT
 CAN  OPERATE  INTERACTIVELY  AND/OR  AUTONOMOUSLY FOR RECIPIENTS WHO ARE
 SEVEN YEARS OF AGE OR OLDER AND WILL BE USING SUCH A DEVICE SOLELY  WITH
 APPROPRIATELY PRESCRIBED INSULIN CARTRIDGES; PROVIDED RECIPIENTS YOUNGER
 THAN  SEVEN  YEARS  OLD  MAY USE THE REMOTELY CONNECTED INSULIN DELIVERY
 DEVICE WITH ADULT SUPERVISION. COVERAGE OF SUCH REMOTELY CONNECTED INSU-
 LIN PENS SHALL BE PROVIDED UNDER THE PHARMACY BENEFIT OF MEDICAL ASSIST-
 ANCE FOR ALL ELIGIBLE PATIENTS  WITH  DIABETES  AND  THE  COST  OF  SUCH
 SERVICES,  INCLUDING  THE  COST  TO  ADMINISTER  SUCH  BENEFIT, SHALL BE
 ADEQUATELY REFLECTED IN MANAGED CARE ORGANIZATION PREMIUM PAYMENTS.
   § 2. This act shall take effect January 1, 2022.
