 AN ACT authorizing the county of Suffolk to alienate and discontinue the
   use of certain parklands
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Notwithstanding the failure of the county  of  Suffolk,  to
 seek  and  receive state legislative authorization to alienate the park-
 lands described in section four of this act prior to such parkland being
 alienated, such alienation is hereby validated, legalized, ratified  and
 confirmed.
   §  2.  Subject  to  the provisions of this act, the county of Suffolk,
 acting by and through its governing body and upon such terms and  condi-
 tions as determined by such body, is hereby authorized to discontinue as
 parklands  and  to  alienate the lands described in section four of this
 act for use by the county department of public works.
   § 3. The authorization provided in section two of this  act  shall  be
 effective  only  upon  the condition that the county of Suffolk dedicate
 the lands described in section five of this act as  parklands,  provided
 that  the  county  of  Suffolk has never used such lands for public open
 space or park purposes.
   § 4. The parklands authorized by section two of this act to be  alien-
 ated are more particularly described as follows:
 District 900 Section 331 Block 1 Lot 2:
   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 1 to 16, inclusive, in Block 14, as shown on  the  "Map
 of Suffolk Terrace", Section D, filed in the office of the Suffolk Coun-
 ty  Clerk  on  August  6,  1910,  as Map Number 517. Said tract contains
 40,000 square feet, or 0.918 acres, more or less.
 District 900 Section 331 Block 1 Lot 3:

 of Suffolk Terrace", Section D, filed in the office of the Suffolk Coun-
 ty  Clerk  on  August  6,  1910,  as Map Number 517. Said tract contains
 40,000 square feet, or 0.918 acres, more or less.

 40,000 square feet, or 0.918 acres, more or less.

   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 1 to 16, inclusive, in Block 19, as shown on  the  "Map
 of Suffolk Terrace", Section D, filed in the office of the Suffolk Coun-
 ty  Clerk  on  August  6,  1910,  as Map Number 517. Said tract contains
 40,000 square feet, or 0.918 acres, more or less.
 District 900 Section 331 Block 1 Lot 6:
   All that certain piece or parcel of  land  situated  at  the  Town  of
 Southampton, Suffolk County, New York, being more particularly described
 as  follows:  Lots  1  to  8, inclusive, and Lots 11 to 16, inclusive in
 Block 20, as shown on the "Map of Suffolk Terrace", Section D, filed  in
 the  office of the Suffolk County Clerk on August 6, 1910, as Map Number
 517.  Said tract contains 35,000 square feet, or 0.803  acres,  more  or
 less.
 District 900 Section 331 Block 1 Lot 7:
   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 9 & 10, in Block 20, as shown on the  "Map  of  Suffolk
 Terrace",  Section D, filed in the office of the Suffolk County Clerk on
 August 6, 1910, as Map Number 517.  Said  tract  contains  5,000  square
 feet, or 0.115 acres, more or less.

   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 1 to 16, inclusive, in Block 22, as shown on  the  "Map
 of Suffolk Terrace", Section D, filed in the office of the Suffolk Coun-
 ty  Clerk  on  August  6,  1910,  as Map Number 517. Said tract contains
 40,000 square feet, or 0.918 acres, more or less.

   All that certain piece or parcel of  land  situated  at  the  Town  of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 1 to 16, inclusive, in Block 1, as shown on the "Map of
 Suffolk  Terrace",  Section E, filed in the office of the Suffolk County
 Clerk on August 6, 1910, as Map Number 517. Said tract  contains  40,000
 square feet, or 0.918 acres, more or less.
 District 900 Section 331 Block 1 Lot 13:
   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 1 to 18, inclusive, in Block 18, as shown on  the  "Map
 of Suffolk Terrace", Section D, filed in the office of the Suffolk Coun-
 ty  Clerk  on  August  6,  1910,  as Map Number 517. Said tract contains
 45,000 square feet, or 1.033 acres, more or less.

   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being more particularly described
 as follows: Lots 1 to 6, inclusive, in Block 15, as shown on the "Map of
 Suffolk Terrace", Section D, filed in the office of the  Suffolk  County
 Clerk  on  August 6, 1910, as Map Number 517. Said tract contains 15,000
 square feet, or 0.344 acres, more or less.
 District 900 Section 331 Block 1 Part of Lot 10:
   All that certain piece or parcel of  land  situated  at  the  Town  of
 Southampton,   Suffolk   County,   New   York,   being   part   of  Lots
 1,2,5,6,7,8,14,15, and16, in Block 3, as shown on the  "Map  of  Suffolk
 Terrace",  Section E, filed in the office of the Suffolk County Clerk on
 August 6, 1910, as Map Number 517,  when  put  together  said  lots  are
 described  as  follows:  Beginning  at the northwest corner of Lot 5, on
 said map, continue Due East for a distance of 190.00 feet; thence  South
 30  degrees  00  minutes  00 seconds West, for a distance of 74.00 feet;
 thence North 68 degrees 18 minutes 20 seconds West, for  a  distance  of
 110.00  feet;  thence South 19 degrees 00 minutes 00 seconds West, for a
 distance of 156.07 feet; thence Due North for a distance of 171.00 feet,
 to the Point of Beginning. Said tract contains 10,595  square  feet,  or
 0.243 acres, more or less.
 District 900 Section 331 Block 1 Part of Lot 11:
   All  that  certain  piece  or  parcel  of land situated at the Town of
 Southampton, Suffolk County, New York, being part  of  Lots  13  to  17,
 inclusive,  in  Block  2,  as  shown  on the   "Map of Suffolk Terrace",
 Section E, filed in the office of the Suffolk County Clerk on August  6,
 1910,  as  Map  Number 517, when put together said lots are described as
 follows:  Beginning at the northwest corner of  Lot  17,  on  said  map,
 continue  Due East for a distance of 52.00 feet; thence South 20 degrees
 38 minutes 49 seconds West, for a distance of 147.47  feet;  thence  Due
 North  for  a  distance  of 138.00 feet, to the Point of Beginning. Said
 tract contains 3,588 square feet, or 0.082 acres, more or less.
 District 900 Section 331 Block 1 Part of Lot 12:
   All that certain piece or parcel of  land  situated  at  the  Town  of
 Southampton, Suffolk County, New York, being part of Lots 1 to 4, inclu-
 sive  and all of Lots 5 to 14, inclusive, in Block 21, as shown on the "
 Map of Suffolk Terrace", Section D, filed in the office of  the  Suffolk
 County  Clerk  on  August  6, 1910, as Map Number 517, when put together
 said lots are described as follows: Beginning at the northwest corner of
 Lot 14, on said map, continue Due East for a distance  of  100.00  feet;
 thence  Due  South,  for  a  distance  of 270.00 feet; thence South   20
 degrees 33 minutes 22 seconds West, for a distance of 85.44 feet; thence
 Due West, for a distance of 70.00 feet; thence Due North for a  distance
 of  350.00  feet,  to the Point of Beginning. Said tract contains 33,800
 square feet, or 0.776 acres, more or less.
   All parcels combined contain 8.907 Acres, more or less.
   § 5. Prior to the  discontinuance  and  alienation  of  the  parklands
 described in section four of this act, the county of Suffolk shall dedi-
 cate as parklands such land described as follows:
   Parcel A:
   All  that  certain  piece or parcel of land, situated at West Hampton,
 Town of Southampton, Suffolk County, New York, being  more  particularly
 described as follows:
   Beginning  at  the  northeast  corner  of  the  parcel  herein  to  be
 described, said corner having a New York State Plane Coordinate Value of

 225.00 feet,

   § 6. In the event that the fair market value of the lands described in
 section five of this act to be dedicated as parklands by the  county  of
 Suffolk  pursuant  to this act are not equal to or greater than the fair
 market value of the parklands to be alienated as  described  in  section
 four of this act, the county of Suffolk shall dedicate the difference of
 the  fair  market value of the lands to be alienated and the lands to be
 dedicated for the acquisition of  additional  parklands  and/or  capital
 improvements to existing park and recreational facilities.
   §  7.  In  the  event  that the county of Suffolk received any funding
 support or assistance from the  federal  government  for  the  purchase,
 maintenance or improvement of the parklands set forth in section four of
 this  act, the discontinuance and alienation of such parkland authorized
 by the provisions of this act  shall  not  occur  until  the  county  of
 Suffolk  has  complied  with  any federal requirements pertaining to the
 alienation or conversion of parklands, including satisfying  the  secre-
 tary of the interior that the alienation or conversion complies with all
 conditions which the secretary of the interior deems necessary to assure
 the substitution of other lands shall be equivalent in fair market value
 and usefulness to the lands being alienated or converted.
   § 8. This act shall take effect immediately.
