 AN ACT to amend the civil rights law, in relation to  excluding  certain
   works and individuals from violations of the right of publicity
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph d of subdivision 2 of section 50-f of  the  civil
 rights law is amended by adding a new subparagraph v to read as follows:
   V.  WORKS IDENTIFIED PURSUANT TO THIS PARAGRAPH SHALL NOT VIOLATE THIS
 SECTION, REGARDLESS OF THE MEDIUM OR MEANS OF TRANSMISSION.
   § 2. Subdivisions 10, 11 and 12 of section 50-f of  the  civil  rights
 law  are  renumbered subdivisions 11, 12 and 13 and a new subdivision 10
 is added to read as follows:
   10. NOTHING IN THIS SECTION SHALL APPLY TO  A  PERSON  THAT  OFFERS  A
 SERVICE  THAT  DISPLAYS, OFFERS FOR SALE OR LICENSE, SELLS OR LICENSES A
 WORK OF ART OR OTHER VISUAL  WORK,  OR  AUDIOVISUAL  WORK,  TO  A  USER,
 PROVIDED THE TERMS OF SUCH SALE OR LICENSE DO NOT AUTHORIZE SUCH USER TO
 ENGAGE IN ACTS THAT CONSTITUTE A VIOLATION OF THIS SECTION.
   §  3.  This  act  shall  take  effect on the same date and in the same
 manner as chapter 304 of the laws of 2020, takes effect.

 AN ACT to amend the civil rights law, in relation to  excluding  certain
   works and individuals from violations of the right of publicity
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
