 AN ACT to  amend  the  executive  law,  in  relation  to  requiring  the
   submission of building inspection reports
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The executive law is amended by adding a new section  381-a
 to read as follows:
   §  381-A.   BUILDING INSPECTION REPORTS. 1. WHEN A BUILDING INSPECTION
 REPORT IS PREPARED AFTER A BUILDING IS  INSPECTED,  THE  OWNER  OF  SUCH
 BUILDING  SHALL  SUBMIT  SUCH  REPORT  WITHIN THIRTY DAYS OF SUCH REPORT
 BEING PREPARED TO THE APPROPRIATE DEPARTMENT OR OFFICIAL  THAT  ENFORCES
 ANY  BUILDING  CODES,  RULES AND REGULATIONS FOR THE LOCAL GOVERNMENT IN
 THE MUNICIPALITY IN WHICH THE BUILDING IS LOCATED.
   2. (A) THE LOCAL GOVERNMENT DEPARTMENT OR  OFFICIAL  THAT  RECEIVES  A
 BUILDING  INSPECTION  REPORT  SHALL  REVIEW  SUCH REPORT AND ESTABLISH A
 TIMEFRAME IN WHICH ANY REPAIRS OR IMPROVEMENTS TO THE  BUILDING  IDENTI-
 FIED IN SUCH REPORT SHALL BE COMPLETED BY THE OWNER OF SUCH BUILDING.
   (B)  IMMEDIATELY  UPON  THE EXPIRATION OF THE TIMEFRAME ESTABLISHED BY
 THE LOCAL GOVERNMENT DEPARTMENT OR OFFICIAL, THE OWNER OF SUCH  BUILDING
 SHALL  SUBMIT  A  CERTIFICATION  THAT THE REPAIRS OR IMPROVEMENTS TO THE
 BUILDING HAVE BEEN COMPLETED TO  SUCH  LOCAL  GOVERNMENT  DEPARTMENT  OR
 OFFICIAL.
   3.  UPON SUBMISSION OF THE CERTIFICATION, THE LOCAL GOVERNMENT DEPART-
 MENT  OR  OFFICIAL  MAY  CONDUCT AN INSPECTION OF THE BUILDING TO ENSURE
 THAT THE REPAIRS OR IMPROVEMENTS WERE COMPLETED.
   4. FAILURE TO SUBMIT THE CERTIFICATION OR IF IT IS DETERMINED THAT THE
 REPAIRS OR IMPROVEMENTS TO  THE  BUILDING  IDENTIFIED  IN  THE  BUILDING
 INSPECTION  REPORT  HAVE  NOT BEEN COMPLETED, THE OWNER OF SUCH BUILDING
 SHALL BE SUBJECT TO PENALTIES.
