 AN ACT to amend the criminal procedure law, in relation to  requiring  a
   nominal  bail  informational  proceeding  for any defendant being held
   solely due to a bail amount of less than ten dollars

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  criminal  procedure  law  is amended by adding a new
 section 530.41 to read as follows:
 § 530.41 NOMINAL BAIL INFORMATIONAL PROCEEDINGS.
   WHEN A DEFENDANT IS BEING HELD FOR ONE OR MORE CHARGES SOLELY DUE TO A
 BAIL AMOUNT OF LESS THAN TEN  DOLLARS,  SUCH  INDIVIDUAL  SHALL,  WITHIN
 FORTY-EIGHT HOURS, BE BROUGHT BEFORE THE COURT FOR A NOMINAL BAIL INFOR-
 MATIONAL PROCEEDING AND INFORMED OF SUCH BAIL AMOUNT.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law.
