 AN ACT to amend the public health  law,  in  relation  to  removing  the
   mandatory surcharge placed on the purchase of hearing aids from desig-
   nated providers of services
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 2807-j of the  public  health  law  is  amended  by
 adding a new subdivision 3-a to read as follows:
   3-A.   NET  PATIENT  SERVICE  REVENUES  FOR  DESIGNATED  PROVIDERS  OF
 SERVICES, FOR  PURPOSES  OF  THIS  SECTION,  SHALL  NOT  INCLUDE  MONEYS
 RECEIVED  FROM  THE  PURCHASE  OF HEARING AIDS AS DEFINED IN SUBDIVISION
 SEVEN OF SECTION SEVEN HUNDRED EIGHTY-NINE OF THE GENERAL BUSINESS  LAW,
 ACCORDINGLY, NO SURCHARGE SHALL BE IMPOSED ON SUCH PURCHASES.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law, provided, however, that  the  amendments  to  section
 2807-j  of  the  public health law made by section one of this act shall
 not affect the expiration of such section and shall be deemed to  expire
 therewith.  Effective immediately, the addition, amendment and/or repeal
 of  any  rule or regulation necessary for the implementation of this act
 on its effective date are authorized to be  made  and  completed  on  or
 before such effective date.
