2021-A9305 (ACTIVE) - Summary

Prohibits municipal employees appointed by the chief executive officer of a municipality or the governing body of a municipality, who are not members of a collective bargaining unit, from serving as political party officers in any capacity; exempts municipal employees appointed by a school district or fire district.

 AN  ACT  to  amend the general municipal law, in relation to prohibiting
   certain municipal employees from serving as political party officers
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Section  806  of  the general municipal law is amended by
 adding a new subdivision 3 to read as follows:
   3. MUNICIPAL EMPLOYEES APPOINTED BY THE CHIEF EXECUTIVE OFFICER  OF  A
 MUNICIPALITY  OR  THE  GOVERNING  BODY  OF  A  MUNICIPALITY, WHO ARE NOT
 MEMBERS OF A COLLECTIVE BARGAINING UNIT, ARE PROHIBITED FROM SERVING  AS
 POLITICAL  PARTY OFFICERS IN ANY CAPACITY. FOR PURPOSES OF THIS SECTION,
 THE TERM POLITICAL PARTY OFFICER SHALL INCLUDE ANY PERSON SERVING IN ANY
 CAPACITY ON A COMMITTEE  AUTHORIZED  PURSUANT  TO  ARTICLE  TWO  OF  THE
 ELECTION  LAW.    THIS  SECTION  SHALL  NOT APPLY TO MUNICIPAL EMPLOYEES
 APPOINTED BY A SCHOOL DISTRICT OR FIRE DISTRICT.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law.
