 AN ACT to amend the education law, in relation to establishing a contin-
   uing education fund for educators
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new section 3611-a
 to read as follows:
   § 3611-A. CONTINUING EDUCATION FUND FOR EDUCATORS.  1. THERE IS HEREBY
 ESTABLISHED IN THE JOINT  CUSTODY  OF  THE  STATE  COMPTROLLER  AND  THE
 COMMISSIONER  OF TAXATION AND FINANCE A FUND TO BE KNOWN AS THE CONTINU-
 ING EDUCATION FUND FOR EDUCATORS.
   2. THE COMMISSIONER SHALL SET ASIDE AN AMOUNT OF FIFTY MILLION DOLLARS
 ON AN ANNUAL BASIS FOR GRANTS AWARDED PURSUANT TO THIS  SECTION.  MONEYS
 SHALL  BE  PAID  OUT  OF  THE FUND ON THE AUDIT AND WARRANT OF THE STATE
 COMPTROLLER ON VOUCHERS CERTIFIED OR APPROVED BY THE COMMISSIONER.
   3. A SCHOOL DISTRICT MAY NOMINATE A PUBLIC SCHOOL  TEACHER  TO  PURSUE
 ADDITIONAL CERTIFICATIONS OR DEGREES, THE COST OF WHICH WOULD BE COVERED
 BY  THE FUNDS PURSUANT TO THIS SECTION. NOMINEES SHALL BE EVALUATED ON A
 COMPETITIVE BASIS AND SUCH GRANTS SHALL BE AWARDED ACCORDINGLY. IF  SUCH
 NOMINEE  STAYS  IN  THE  SCHOOL DISTRICT FOR TWO TO FOUR YEARS, THE FUND
 SHALL COVER FIFTY PERCENT OF THE COST OF ANY ADDITIONAL CERTIFICATION OR
 DEGREE. IF SUCH NOMINEE STAYS IN THE SCHOOL DISTRICT FOR MORE THAN  FOUR
 YEARS, THE FUND SHALL COVER ONE HUNDRED PERCENT OF THE COST OF ANY ADDI-
 TIONAL CERTIFICATION OR DEGREE.
   4.  THE  COMMISSIONER MAY ADOPT RULES AND REGULATIONS AS ARE NECESSARY
 AND APPROPRIATE TO CARRY OUT THE PROVISIONS OF THIS SECTION.
   5. THE COMMISSIONER SHALL ISSUE AN ANNUAL REPORT  TO  THE  LEGISLATURE
 CONCERNING THE OVERALL AND INDIVIDUAL PROGRAMS, DETAILING THEIR IMPACT.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law.
