LAWLER -- read once and referred to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to requiring the workers' compensation board to provide notice to covered employers before a fine is assessed for failure to obtain workers' compensation coverage THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 151 of the workers' compensation law is amended by adding a new subdivision 15 to read as follows: 15. AN AFFECTED EMPLOYER WHO IS FIFTY-FIVE YEARS OF AGE OR OLDER WHO HIRES A HOME HEALTH AIDE SHALL BE PROVIDED WRITTEN NOTICE BY THE WORK- ERS' COMPENSATION BOARD OF THE FAILURE TO OBTAIN WORKERS' COMPENSATION COVERAGE BEFORE BEING ASSESSED AND FINED. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14850-01-2
