AN ACT to amend the real property tax law, in relation to requiring the
state board of real property tax services to hold not less than five
meetings annually and authorizing the board to hold certain meetings
remotely
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The real property tax law is amended by adding a new
section 201-b to read as follows:
§ 201-B. MEETINGS OF THE STATE BOARD OF REAL PROPERTY TAX SERVICES. 1.
THE BOARD SHALL HOLD NOT LESS THAN FIVE MEETINGS PER YEAR FOR THE
PURPOSE OF CONDUCTING PUBLIC BUSINESS. ALL SUCH MEETINGS SHALL BE OPEN
TO THE PUBLIC AND CONDUCTED IN ACCORDANCE WITH ALL APPLICABLE PROVISIONS
OF ARTICLE SEVEN OF THE PUBLIC OFFICERS LAW.
2. (A) EXCEPT AS PROVIDED IN PARAGRAPH (B) OF THIS SUBDIVISION, THE
BOARD SHALL BE AUTHORIZED TO MEET AND TAKE SUCH ACTIONS AUTHORIZED BY
LAW WITHOUT PERMITTING IN PUBLIC IN-PERSON ACCESS TO MEETINGS AND
AUTHORIZE SUCH MEETINGS TO BE HELD REMOTELY BY CONFERENCE CALL OR SIMI-
LAR SERVICE, PROVIDED THAT THE PUBLIC HAS THE ABILITY TO VIEW OR LISTEN
TO SUCH PROCEEDING AND THAT SUCH MEETINGS ARE RECORDED AND LATER TRAN-
SCRIBED.
(B) NOTWITHSTANDING ANY CONTRARY PROVISION OF PARAGRAPH (A) OF THIS
SUBDIVISION, THE BOARD SHALL HOLD NOT LESS THAN ONE OF THE MEETINGS
REQUIRED BY SUBDIVISION ONE OF THIS SECTION IN A PUBLIC LOCATION AT
WHICH PUBLIC IN-PERSON ATTENDANCE SHALL BE PERMITTED. NO SUCH MEETING
SHALL SATISFY THE REQUIREMENTS OF THIS PARAGRAPH UNLESS A QUORUM OF THE
MEMBERS OF THE BOARD IS PHYSICALLY PRESENT AT THE PLACE OF THE MEETING
SPECIFIED IN THE PUBLIC NOTICE ISSUED PURSUANT TO SECTION ONE HUNDRED
FOUR OF THE PUBLIC OFFICERS LAW.
§ 2. This act shall take effect immediately.
