2021-A9584 (ACTIVE) - Summary

Relates to transfers of civil service sections 55-b and 55-c employees; provides that such employees shall be afforded the opportunity to transfer into other authorized positions provided they meet the requirements of such vacant positions and the position to which transfer is sought is at the same or substantially the same or a lower salary level than the position from which transfer is sought.

 AN ACT to amend the civil service law, in relation to transfers of civil
   service sections 55-b and 55-c employees
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 55-b of the civil service law is amended by  adding
 a new subdivision 3 to read as follows:
   3.  THOSE EMPLOYEES HIRED UNDER SUBDIVISION ONE OF THIS SECTION, SHALL
 BE AFFORDED THE OPPORTUNITY TO TRANSFER INTO ANY  VACANCIES  THAT  OCCUR
 WITHIN THE TWELVE HUNDRED POSITIONS AUTHORIZED BY THIS SECTION, PROVIDED
 THEY  MEET THE REQUIREMENTS OF SUCH VACANT POSITIONS AND THE POSITION TO
 WHICH TRANSFER IS SOUGHT IS AT THE SAME OR SUBSTANTIALLY THE SAME  OR  A
 LOWER SALARY LEVEL THAN THE POSITION FROM WHICH TRANSFER IS SOUGHT.
   §  2. Section 55-c of the civil service law, as amended by chapter 603
 of the laws of 1995, is amended by adding a new subdivision 4 to read as
 follows:
   4. THOSE EMPLOYEES HIRED UNDER SUBDIVISION ONE OF THIS SECTION,  SHALL
 BE  AFFORDED  THE  OPPORTUNITY TO TRANSFER INTO ANY VACANCIES THAT OCCUR
 WITHIN THE FIVE HUNDRED POSITIONS AUTHORIZED BY THIS  SECTION,  PROVIDED
 THEY  MEET THE REQUIREMENTS OF SUCH VACANT POSITIONS AND THE POSITION TO
 WHICH TRANSFER IS SOUGHT IS AT THE SAME OR SUBSTANTIALLY THE SAME  OR  A
 LOWER SALARY LEVEL THAN THE POSITION FROM WHICH TRANSFER IS SOUGHT.
   § 3. This act shall take effect immediately.
