TITLE OF BILL:

An act to amend the executive law, in relation to directing the state
director of veterans' affairs to submit a plan relating to coordinated
services for service-disabled veterans to the veterans' affairs commis-
sion

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to expand the opportunities and services
made available by the New York State Division of Veterans' Affairs for
state for service-disabled veterans who come back home.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 of the bill contains the legislative intent of establishing a
statewide comprehensive program to coordinate services and programs for
service-disabled veterans.

Section 2 expands provisions related to the Veterans' Affairs Commission
to require the state director of veterans' affairs to submit a plan to
the Commission by July 1, 2022, and every 5 years thereafter, for coor-
dinated services for service-disabled veterans.  The Commission must
approve, modify or reject the plan from the director within 90 days of
receiving the plan. If the Commission rejects or modifies the plan, the
director must resubmit the plan to the Commission for approval within
six months. A copy of the approved plan must be sent to the governor,
speaker of the assembly and temporary president of the senate within 30
days of approval by the Commission.

 
JUSTIFICATION:

There are many veterans returning home from active military duty with
service-related disabilities. This bill would create an interagency
collaboration to identify the needs and services that service-disabled
veterans require and a more efficient matching of these needs to State
resources. New York State must provide additional assistance and support
to service-disabled veterans to better inform them of available services
and how such services can be accessed.

 AN ACT to amend the executive law, in relation to  directing  the  state
   director of veterans' affairs to submit a plan relating to coordinated
   services  for  service-disabled  veterans  to  the  veterans'  affairs

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Legislative intent. The legislature hereby recognizes that
 New York state's veterans, particularly those who  suffered  service-re-
 lated disabilities, have unique needs as a result of the sacrifices they
 made  during  their  military service. It is also hereby acknowledged by
 the legislature that due to the complexity of their needs, such individ-
 uals require accessible, coordinated, and  specialized  services  within
 their  communities  from multiple state and local agencies. The legisla-
 ture finds that there is an immediate need for a statewide comprehensive
 program to coordinate such services.
   § 2. Section 352 of the executive law  is  amended  by  adding  a  new
 subdivision 6 to read as follows:
   6.  THE  STATE  DIRECTOR SHALL SUBMIT A PLAN TO THE COMMISSION BY JULY
 FIRST, TWO THOUSAND TWENTY-TWO, AND EVERY FIVE  YEARS  THEREAFTER,  WITH
 FINDINGS AND RECOMMENDATIONS TO:
   (A) PROMOTE THE IMPLEMENTATION OF A COMPREHENSIVE STATEWIDE PROGRAM OF
 COORDINATED SERVICES FOR SERVICE-DISABLED VETERANS THAT INCLUDES:
   (I) MATTERS PERTAINING TO EDUCATIONAL TRAINING AND RETRAINING SERVICES
 AND FACILITIES;
   (II) HEALTH, MEDICAL AND REHABILITATION SERVICES;
   (III) EMPLOYMENT AND RE-EMPLOYMENT SERVICES;
   (IV) HOUSING OPTIONS;

   (V) TRANSPORTATION OPTIONS;
   (VI) LONG TERM CARE OPTIONS;
   (VII) PERSONAL CARE;
   (VIII) DAY PROGRAM SERVICE OPTIONS;
   (IX) FAMILY OUTREACH; AND
   (X) OTHER ESSENTIAL SERVICES THAT MAXIMIZE EXISTING RESOURCES;
   (B)  DISSEMINATE  GENERAL  INFORMATION  ABOUT  AVAILABLE  SERVICES  TO
 SERVICE-DISABLED VETERANS AND HOW SUCH SERVICES MAY BE ACCESSED; AND
   (C) CONDUCT AN ONGOING EVALUATION ON THE  NEEDS  OF  SERVICE  DISABLED
 VETERANS.
   UPON  RECEIPT  OF  SUCH  PLAN  FROM THE STATE DIRECTOR, THE COMMISSION
 SHALL VOTE WITHIN NINETY DAYS ON WHETHER TO APPROVE,  MODIFY  OR  REJECT
 THE  PLAN;  PROVIDED, HOWEVER, IF THE COMMISSION MODIFIES OR REJECTS THE
 PLAN, THE STATE DIRECTOR SHALL RESUBMIT THE PLAN TO THE COMMISSION WITH-
 IN SIX MONTHS FOR APPROVAL.
   UPON APPROVAL OF THE PLAN BY THE COMMISSION, THE STATE DIRECTOR  SHALL
 SUBMIT  WITHIN  THIRTY  DAYS  OF SUCH APPROVAL A COPY OF THE PLAN TO THE
 GOVERNOR, TEMPORARY PRESIDENT OF THE SENATE AND SPEAKER OF THE ASSEMBLY.
   § 3. This act shall take effect immediately.

TITLE OF BILL:

An act to amend the executive law, in relation to directing the veterans
service commission to submit a report relating to coordinated services
for veterans with service-connected disabilities to the veterans'

PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to review the services that are currently
available to veterans with service-connected disabilities by state and
local veterans' service agencies and identify any deficiencies in the
availability, accessibility and delivery of these services.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 of the bill contains the legislative intent of establishing a
statewide comprehensive program to coordinate services and programs for
veterans with service-connected disabilities.

Section 2 requires the commission, in consultation with the Office of
the Chief Disability Officer, by April 1, 2024, to submit a report to
the director reviewing the services provided to veterans with service-
connected disabilities. The report shall provide any findings and recom-
mendations on how to improve services and better coordinate how perti-
nent information can be better communicated to veterans. The report
shall be available for public review and comment.

Section 3 contains the effective date

 
JUSTIFICATION:

There are many veterans returning home from active military duty with
service-related disabilities. This bill would create an interagency

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Legislative intent. The legislature hereby recognizes that

 service-connected  disabilities,  have  unique  needs as a result of the

 acknowledged  by  the  legislature  that  due to the complexity of their

 REPORT  TO THE DIRECTOR REVIEWING THE SERVICES PROVIDED TO VETERANS WITH
 SERVICE-CONNECTED DISABILITIES BY  STATE  AND  LOCAL  VETERANS'  SERVICE
 AGENCIES.  THE REPORT SHALL IDENTIFY ANY DEFICIENCIES IN THE AVAILABILI-
 TY, ACCESSIBILITY AND DELIVERY OF SUCH SERVICES.

   (A) THE SERVICES REVIEWED IN THE REPORT  SHALL  INCLUDE,  BUT  NOT  BE
 LIMITED TO:
   (I)  EDUCATION  AND  VOCATION RELATED SERVICES, INCLUDING TRAINING AND
 RETRAINING SERVICES;
   (II) HEALTHCARE SERVICES, INCLUDING MEDICAL, MENTAL, DENTAL, REHABILI-
 TATION AND COUNSELING SERVICES;
   (III) CAREER, EMPLOYMENT AND RE-EMPLOYMENT SERVICES;
   (IV) HOUSING RELATED SERVICES;
   (V) TRANSPORTATION SERVICES;
   (VI) LONG TERM CARE SERVICES;
   (VII) PERSONAL CARE SERVICES;
   (VIII) ADULT DAY HEALTHCARE SERVICES;
   (IX) FAMILY OUTREACH AND FAMILY CAREGIVER SERVICES; AND
   (X) LEGAL SERVICES, INCLUDING VETERANS'  BENEFITS  CLAIMS  ASSISTANCE.
 THE  REPORT  SHALL  PROVIDE  ANY  FINDINGS AND RECOMMENDATIONS AS TO HOW
 THESE SERVICES MAY BE IMPROVED, OR BETTER COORDINATED AND  HOW  INFORMA-
 TION PERTAINING TO SUCH SERVICES CAN BE BETTER COMMUNICATED TO VETERANS.
 TO  THE  EXTENT  FEASIBLE,  THE  REPORT SHALL ALSO IDENTIFY ANY NEEDS OF
 VETERANS WITH SERVICE-CONNECTED DISABILITIES THAT ARE UNMET BY  EXISTING
 SERVICES AND INCLUDE RECOMMENDATIONS AS TO HOW THEY MAY BE ADDRESSED.
   (B)  THE REPORT SHALL ALSO INCLUDE FINDINGS AND RECOMMENDATIONS ON THE
 NECESSITY AND FEASIBILITY  OF  IMPLEMENTING  A  COMPREHENSIVE  STATEWIDE
 PROGRAM OF COORDINATED SERVICE FOR VETERANS WITH SERVICE-CONNECTED DISA-
 BILITIES.  ONCE  COMPLETED,  THE COMMISSION SHALL PUBLISH SUCH REPORT ON
 THE DIVISION'S WEBSITE AND PROVIDE FOR A THIRTY-DAY PUBLIC COMMENT PERI-
 OD PRIOR TO SUCH REPORT BEING DELIVERED TO THE DIRECTOR. A  SYNOPSIS  OF
 THE COMMENTS SHALL BE INCLUDED IN THE REPORT THAT IS SUBMITTED.
   UPON  THE RECEIPT OF THE REPORT THE STATE DIRECTOR SHALL SUBMIT A COPY
 OF THE REPORT TO THE GOVERNOR, TEMPORARY PRESIDENT  OF  THE  SENATE  AND
 SPEAKER OF THE ASSEMBLY.
   §  3.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
