BILL NUMBER: S1860 SPONSOR: RITCHIE TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to establishing a temporary New York craft beverage permit PURPOSE OR GENERAL IDEA OF BILL: To allow those distillers who manufacture liquor, alcohol and spirits and have a class D license the ability to apply for a one-day permit, as is currently allowed by others who have the same license. SUMMARY OF PROVISIONS: Amends the alcohol and beverage control law by adding a new section 97-b. JUSTIFICATION:

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to establishing a temporary New York craft beverage permit THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 97-b of the alcoholic beverage control law is renumbered section 97-c and a new section 97-b is added to read as follows: § 97-B. TEMPORARY NEW YORK CRAFT BEVERAGE PERMIT. THE LIQUOR AUTHORITY IS HEREBY AUTHORIZED TO ISSUE TEMPORARY PERMITS TO A LICENSED NEW YORK STATE FARM DISTILLERY, BREWERY, WINERY, CIDERY OR MEADERY, EFFECTIVE FOR A PERIOD NOT TO EXCEED TWENTY-FOUR CONSECUTIVE HOURS TO AUTHORIZE THE SALE OF ALL NEW YORK STATE MANUFACTURED LIQUOR, SPIRITS, WINE, BEER, CIDER AND MEAD, AS AUTHORIZED TO BE SOLD IN NEW YORK TASTING ROOMS, AT OUTDOOR OR INDOOR GATHERINGS, FUNCTIONS, OCCASIONS OR EVENTS LOCATED IN A MUNICIPALITY WITH A POPULATION OF LESS THAN ONE MILLION, WITHIN THE HOURS FIXED BY OR PURSUANT TO SUBDIVISION FIVE OF SECTION ONE HUNDRED SIX OF THIS CHAPTER, DURING WHICH ALCOHOLIC BEVERAGES MAY LAWFULLY BE SOLD OR SERVED UPON PREMISES LICENSED TO SELL ALCOHOLIC BEVERAGES AT RETAIL FOR ON-PREMISES CONSUMPTION IN THE COMMUNITY IN WHICH IS LOCATED THE PREMISES IN WHICH SUCH GATHERING, FUNCTION, OCCASION OR EVENT IS HELD. THE FEE FOR SUCH PERMIT SHALL BE FIFTY-TWO DOLLARS. PERMITTEES SHALL PROMINENTLY DISPLAY THEIR NEW YORK STATE FARM DISTILLERY, BREWERY, WINERY, CIDERY OR MEADERY PERMIT AT THE TEMPORARILY PERMITTED EVENT FOR INSPECTION BY ANY REGULATORY AGENCY. SUCH PERMIT AND THE EXERCISE OF THE PRIVILEGE GRANTED THEREBY SHALL BE SUBJECT TO SUCH RULES OF THE LIQUOR AUTHORITY AS IT DEEMS NECESSARY. § 2. This act shall take effect immediately.
