 AN ACT to amend the parks, recreation and historic preservation law,  in
   relation to annual vehicular access for active duty service members

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The parks, recreation  and  historic  preservation  law  is
 amended by adding a new section 13.22 to read as follows:
   §  13.22  ANNUAL  VEHICULAR ACCESS FOR ACTIVE DUTY SERVICE MEMBERS. 1.
 NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE  CONTRARY,  THE
 OFFICE  OR  OTHER  STATE  AGENCY  HAVING JURISDICTION OF A STATE PARK OR
 RECREATIONAL FACILITY WHICH HAS THE AUTHORITY TO ISSUE  AN  ANNUAL  PASS
 FOR  VEHICULAR  ACCESS  PURSUANT TO THIS ARTICLE SHALL ISSUE SUCH ANNUAL
 PASS FOR VEHICULAR ACCESS WITHOUT  CHARGE  TO  AN  ACTIVE  DUTY  SERVICE
 MEMBER AND HIS OR HER IMMEDIATE FAMILY AT ANY STATE PARK OR RECREATIONAL
 FACILITY UPON PRESENTATION OF SUCH ACTIVE DUTY SERVICE MEMBER'S MILITARY
 IDENTIFICATION CARD.
   2.  FOR  THE  PURPOSES  OF  THIS SECTION, "ACTIVE DUTY SERVICE MEMBER"
 SHALL MEAN A RESIDENT OF THE STATE WHO IS AN ACTIVE MEMBER OF THE ORGAN-
 IZED MILITIA OF THE STATE OF NEW YORK AS DEFINED BY SECTION ONE  OF  THE
 MILITARY LAW.
   3.  THE OFFICE OR OTHER STATE AGENCY HAVING JURISDICTION SHALL PROMUL-
 GATE SUCH RULES AND REGULATIONS AS MAY BE NECESSARY  TO  CARRY  OUT  THE
 PROVISIONS OF THIS SECTION.
   § 2. This act shall take effect on the one hundred twentieth day after
 it  shall  have become a law. Effective immediately the addition, amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation of this act on its effective date are authorized to be  made  and
 completed on or before such date.
