BILL NUMBER: S2908 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the public health law, in relation to fluoride additives in water PURPOSE: To set an optimal target level and a maximum level of fluoride for public water systems SUMMARY OF PROVISIONS: Section 1 of the bill would amend section 1100-a of the public health law by adding a new subdivision 3 to set an optimal fluoride target level of 0.7 milligrams per liter and a maximum fluoride level of 0.8 milligrams per liter for any public water supply to which fluoride is added. Section 2 of the bill sets forth the effective date.

KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to fluoride additives in water THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1100-a of the public health law is amended by adding a new subdivision 5 to read as follows: 5. FOR ANY PUBLIC WATER SUPPLY TO WHICH ANY COUNTY, CITY, TOWN, VILLAGE, OR PUBLIC AUTHORITY ADDS A FLUORIDE COMPOUND, THE OPTIMAL FLUORIDE TARGET LEVEL SHALL BE 0.7 MILLIGRAMS PER LITER AND THE FLUORIDE LEVEL SHALL NOT EXCEED 0.8 MILLIGRAMS PER LITER. THE DEPARTMENT SHALL MAKE RULES AND REGULATIONS TO ENFORCE THIS SUBDIVISION. § 2. This act shall take effect on the ninetieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
