AN ACT to amend the labor law, in relation to employer provided sick
leave for purposes of receiving the COVID-19 vaccination; and provid-
ing for the repeal of such provisions upon the expiration thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 196-b of the labor law is amended by adding a new
subdivision 15 to read as follows:
15. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THE
PROVISIONS OF THIS SECTION SHALL APPLY TO LEAVE TAKEN FOR THE PURPOSES
OF RECEIVING THE COVID-19 VACCINATION FOR FOUR HOURS OF PAID LEAVE FOR
EACH OF TWO APPOINTMENTS FOR SUCH VACCINATION, EXCEPT IN THE CASE OF AN
EMPLOYER COVERED BY THE PROVISIONS OF PARAGRAPH A OF SUBDIVISION ONE OF
THIS SECTION, THE LEAVE SHALL BE UNPAID, AND PROVIDED THAT ALL OTHER
PROVISIONS OF THIS SECTION SHALL APPLY TO SUCH LEAVE.
§ 2. This act shall take effect immediately and shall expire and be
deemed repealed December 31, 2022.
