TITLE OF BILL:

An act making adjustments to the calculation of state aid for East Rama-
po central school district for the 2020-2021 school year

 
PURPOSE:

This bill would adjust the state aid calculation for the East Ramapo
central school district in order to offset allocations to eligible
nonpublic schools as required by the federal CARES Act.

 
SUMMARY OF PROVISIONS:

Section one of the bill reduces the pandemic adjustment for the East
Ramapo central school district to zero and imposes a reduction in their
total state aid of 9%.

Section two of the bill relates to the effective date.

 
JUSTIFICATION:

The federal CARES act, through rules promulgated by the US Department of
Education, requires public school districts that receive CARES Act fund-
ing to send funds to eligible non-public schools based on Title 1, Part
A allocations. These rules were established after the 2020-21 state
budget was adopted. In the 2020-21 budget, the State attempted to hold
all districts harmless by utilizing federal CARES act funding. East
Ramapo, however, is one of the most unique districts in the State with a
private school population over three times the size of the public school
population. Therefore, the mandate to send CARES Act funds through Title
1, Part A requires East Ramapo to send $15.6 million or 70% of their
CARES Act allocation to eligible non-public schools providing "equitable
services" to students within their district. This requirement would have
a devastating impact on the East Ramapo school district budget.

This bill would address these unforeseen federal requirements by miti-
gating the district's fiscal impact of complying with the non-public
school allocation. The bill would put East Ramapo in a similar situation
with regard to the CARES Act funding as most Other districts in New York
State and protect their ability to provide educational programs.

 
LEGISLATIVE HISTORY:

The estimated fiscal impact to the State is approximately $15.3 million.

 
EFFECTIVE DATE:
This act shall take effect immediately and shall be deemed to have been
in full force and effect on July 1, 2020 and shall apply to the 2020-21
school year.

 AN ACT making adjustments to the calculation of state aid for East Rama-
   po central school district for the 2020-2021 school year
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. a. Notwithstanding any inconsistent provision of law to the
 contrary,  for  purposes  of  the  pandemic adjustment as defined in the
 appropriation for general support for public schools pursuant to chapter
 53 of the laws of 2020 and subdivision 19 of section 3602 of the  educa-
 tion  law,  the  pandemic  adjustment amount for the East Ramapo central
 school district shall equal zero.
   b. Notwithstanding any provision of law to the contrary,  the  commis-
 sioner of education shall reduce payments for general support for public
 schools due to the East Ramapo central school district for the 2020-2021
 school  year  by  an  amount equal to the product of nine one-hundredths
 (0.09) multiplied by the sum of  (A)  the  amount  set  forth  for  such
 district  as  "TOTAL"  under the heading "2020-21 BASE YEAR AIDS" on the
 school aid computer listing produced by  the  commissioner  in  November
 2020  pursuant to subdivision 21 of section 305 of the education law and
 entitled "CL2122" plus (B) the positive value of the amount set forth as
 "PANDEMIC ADJUSTMENT" on such listing, provided further that  an  amount
 equal  to the amount of such deduction shall be deemed to have been paid
 to the district pursuant to this section for the school  year  in  which
 such deduction is made.
   c.  Notwithstanding  any  provisions  of  law to the contrary, for the
 purposes of an  apportionment  from  the  education  stabilization  fund
 appropriated  in chapter 53 of the laws of 2020, the East Ramapo central
 school district shall be apportioned an amount equal to the  amount  set
 forth  for  such  district  as  "PANDEMIC  ADJUSTMENT" under the heading
 "2020-21 BASE YEAR AIDS" on the school aid computer listing produced  by

 the  commissioner in November 2020 pursuant to subdivision 21 of section
 305 of the education law in support of  the  budget  for  the  2020-2021
 school year and entitled "CL2122".
   §  2.  This  act  shall take effect immediately and shall be deemed to
 have been in full force and effect on July 1, 2020 and  shall  apply  to
 only the 2020-2021 school year.
