BILL NUMBER: S5957 SPONSOR: HARCKHAM TITLE OF BILL: An act to amend the agriculture and markets law, in relation to agricul- tural assessment eligibility for beekeeping land PURPOSE: Relates to agricultural assessment eligibility for beekeeping land SUMMARY OF PROVISIONS: Section 1 amends subdivision 4 of section 301 of the agriculture and markets law to broaden the definition of apiary products operation by increasing the acres used as a single operation and to require that a minimum of ten honeybee colonies per acre of land and any appropriate pollinator plants, or other additional municipal code requirements are met.

HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to agricul- tural assessment eligibility for beekeeping land THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph k of subdivision 4 of section 301 of the agricul- ture and markets law, as added by chapter 341 of the laws of 2008, is amended to read as follows: k. Land used to support an apiary products operation which is owned by the operation and consists of [(i)] not less than [seven] THREE acres nor more than [ten] TWENTY acres used as a single operation in the preceding two years for the production for sale of crops, livestock or livestock products of an average gross sales value of ten thousand dollars or more [or (ii) less than seven acres used as a single opera- tion in the preceding two years for the production for sale of crops, livestock or livestock products of an average gross sales value of fifty thousand dollars or more] WITH A MINIMUM OF TEN HONEYBEE COLONIES PER ACRE OF LAND AND ANY APPROPRIATE POLLINATOR PLANTS, OR OTHER ADDITIONAL MUNICIPAL CODE REQUIREMENTS. The land used to support an apiary products operation shall include, but not be limited to, the land under a struc- ture within which apiary products are produced, harvested and stored for sale; and a buffer area maintained by the operation between the opera- tion and adjacent landowners. Notwithstanding any other provision of this subdivision, rented land associated with an apiary products opera- tion is not eligible for an agricultural assessment based on this para- graph. § 2.
