TITLE OF BILL:

An act to amend the election law, in relation to requiring the county
seat in Wayne county to have at least one polling place designated for
early voting

 
PURPOSE:

Requires the county seat in Wayne County to have at least one polling
place designated for early voting.

 
SUMMARY OF PROVISIONS:

Section one of this bill amends paragraph (a) of subdivision 2 of
section 8-600 of the Election Law to provide that the county seat of
Wayne County may be a designated as an early polling site for the
purposes of such law. (Amends Chapter 74 of 2021).

Section two is the effective date.

 
JUSTIFICATION:

Chapter 74 of the laws of 2021 requires each county board of elections
to include at least one early voting site in the municipality with the
highest population in such county based on the latest federal decennial
census. Chapter 74 also provides that, to the extent practicable, if
such municipality has public transportation routes, such polling place
shall be situated along such transportation routes.

In the case of Wayne County, the Town of Arcadia, which is the largest
municipality in Wayne County, is located in close proximity (less than
1/10 of a mile) to the county seat, Lyons. The Wayne County seat, Lyons,
is also served by public transportation routes.  Additionally, having
this polling site located in the Wayne County Office Building along with
the Board of Elections is both beneficial for voters and instrumental in
the efficient use of time, money and resources. Thus, under these
special circumstances, it is appropriate to authorize Wayne County to
designate the county seat, Lyons, as an early voting site in compliance
with Chapter 74.

 AN ACT to amend the election law, in relation to  requiring  the  county
   seat in Wayne county to have at least one polling place designated for
   early voting

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph (a) of subdivision 2  of  section  8-600  of  the
 election  law,  as amended by chapter 74 of the laws of 2021, is amended
 to read as follows:
   (a) The board of elections shall designate polling  places  for  early
 voting,  which  may  include  the offices of the board of elections, for
 persons to vote early pursuant to this title;  provided,  however,  that
 the municipality with the highest population in each county based on the
 latest  federal decennial census, or the county seat in Washington coun-
 ty, OR THE COUNTY SEAT IN WAYNE COUNTY, shall have at least one  polling
 place designated for early voting, and to the extent practicable if such
 municipality  has public transportation routes, such polling place shall
 be situated along such transportation routes. There shall be  so  desig-
 nated  at  least one early voting polling place for every full increment
 of fifty thousand registered voters in each county;  provided,  however,
 the  number  of  early  voting  polling  places in a county shall not be
 required to be greater than ten unless required by any  other  provision
 of law, and a county with fewer than fifty thousand voters shall have at
 least one early voting polling place.
   § 2. This act shall take effect immediately.
