 Introduced  by Sen. BENJAMIN -- read twice and ordered printed, and when
   printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to including  whether
   an  individual  was in custody on the death certificate for such indi-
   vidual

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Subdivision 1 of section 4141 of the public health law, as
 amended by chapter 398 of the laws of 1997, is amended and a new  subdi-
 vision 5 is added to read as follows:
   1.  The certificate of death shall contain such information, including
 but not limited to the decedent's social  security  number  AND  WHETHER
 SUCH DECEDENT WAS IN THE CUSTODY OF A LAW ENFORCEMENT OFFICER OR CORREC-
 TIONAL  FACILITY  AT THE TIME OF DEATH, and shall be in such form as the
 commissioner may prescribe. AS USED  IN  THIS  SECTION,  THE  TERM  "LAW
 ENFORCEMENT  OFFICER"  MEANS  ANY  PUBLIC  SERVANT  WHO IS AUTHORIZED TO
 CONDUCT AN INVESTIGATION, PROSECUTE OR MAKE AN  ARREST  FOR  A  CRIMINAL
 OFFENSE.
   5. WHERE A DEATH OCCURS IN THE CUSTODY OF A LAW ENFORCEMENT OFFICER OR
 CORRECTIONAL FACILITY, SUCH INFORMATION SHALL BE INCLUDED IN THE PUBLIC-
 LY AVAILABLE STATISTICS PUBLISHED ON THE WEBSITE OF THE DEPARTMENT.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.    Effective  immediately,  the  addition,  amendment
 and/or repeal of any rule or regulation necessary for the implementation
 of  this  act  on  its  effective  date  are  authorized  to be made and
 completed on or before such effective date.
