BILL NUMBER: S6894 SPONSOR: BENJAMIN TITLE OF BILL: An act to amend the executive law, in relation to the independent livery driver benefit fund PURPOSE OR GENERAL IDEA OF BILL: To require any dispatch base or entity, regardless of type, that dispatches to a New York City Livery vehicle affiliated with a New York City livery base, to be a member of the New York Independent Livery Driver Benefit Fund (the "Livery Fund"). This ensures that when livery drivers are involved in accidents, they are eligible for workers compen- sation benefits provided by the Livery Fund. SUMMARY OF PROVISIONS: Section 1 amends subsection 2 of section 160-Aaa of the executive law to define "covered services" to mean all dispatches from a livery base to a livery regardless of where the pick-up or discharge occurs.

BENJAMIN -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the executive law, in relation to the independent livery driver benefit fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 160-aaa of the executive law, as added by chapter 392 of the laws of 2008, is amended to read as follows: 3. "Covered services" means all dispatches from a livery base TO A LIVERY regardless of where the pick-up or discharge occurs. § 2. Subdivision 1 of section 160-fff of the executive law, as added by chapter 392 of the laws of 2008, is amended to read as follows: 1. The membership of the fund shall be comprised of all independent livery bases. NO LOCAL TAXI AND LIMOUSINE COMMISSION SHALL ALLOW ANY BASE OR OTHER ENTITY TO DISPATCH TO A LIVERY WITHOUT THAT BASE OR OTHER ENTITY FIRST BECOMING A MEMBER OF THE FUND. If the workers' compensation board or local taxi and limousine commission revokes a livery base's authorization to act as an independent livery base, it shall cease to be a member of the fund within thirty days. Such revocation shall not enti- tle the livery base to the return of any moneys deposited into the fund. § 3. This act shall take effect immediately.
