BILL NUMBER: S6910 SPONSOR: SERINO TITLE OF BILL: An act to amend the New York state urban development corporation act, in relation to establishing a New York business COVID-19 modification grant program; and providing for the repeal of such provisions upon the expi- ration thereof PURPOSE: To provide grants for businesses and not-for-profits to make the modifi- cations necessary to reopen during the COVID-19 pandemic while preserv- ing public health. SUMMARY OF PROVISIONS: Section 1: Creates the New York Business COVID-19 Modification Grant Program, which shall utilize funds from the federal Coronavirus Aid, Relief, and Economic Security (CARES) Act of 2020 to provide grants to New York businesses and non-profit-making organizations through the

SERINO, TEDISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the New York state urban development corporation act, in relation to establishing a New York business COVID-19 modification grant program; and providing for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1 of chapter 174 of the laws of 1968, constituting the New York state urban development corporation act, is amended by adding a new section 16-bb to read as follows: § 16-BB. NEW YORK BUSINESS COVID-19 MODIFICATION GRANT PROGRAM. 1. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW TO THE CONTRARY, FROM REMAINING AND FUTURE FEDERAL FUNDS PROVIDED FOR COVID-19 RELIEF, INCLUD- ING, BUT NOT LIMITED TO, MONIES THAT HAVE BEEN ALLOCATED TO THE STATE OF NEW YORK BY THE FEDERAL CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY (CARES) ACT OF 2020 (P.L. 116-136) AND THE CONSOLIDATED APPROPRIATIONS ACT OF 2021 (P.L. 116-260) THAT HAVE NOT OTHERWISE BEEN OBLIGATED, THE EMPIRE STATE DEVELOPMENT CORPORATION SHALL MAKE GRANTS AVAILABLE PURSU- ANT TO THIS SECTION TO PROVIDE GRANTS FOR NEW YORK STATE BUSINESS ENTER- PRISES, AS DEFINED IN SECTION ONE HUNDRED THIRTY-NINE-I OF THE STATE FINANCE LAW, OR NON-PROFITMAKING ORGANIZATIONS AS DEFINED IN SECTION ONE HUNDRED NINETY OF THE LABOR LAW, TO COVER EXPENSES RELATED TO COMPLYING WITH ANY STATE-MANDATED GUIDELINES FOR REOPENING, PURSUANT TO ANY EXECU- TIVE ORDER RELATED TO THE STATE DISASTER EMERGENCY DECLARED PURSUANT TO EXECUTIVE ORDER 202 OF 2020, INCLUDING, BUT NOT LIMITED TO, MODIFYING THE LAYOUT OF A BUILDING, TECHNOLOGY UPGRADES, THE PURCHASE OF NEW EQUIPMENT AND SUPPLIES, INCLUDING PERSONAL PROTECTIVE EQUIPMENT, AND TRAINING EMPLOYEES ON NEW BUSINESS PRACTICES NECESSARY TO COMPLY WITH ANY SUCH ORDER. SUCH GRANTS SHALL ALSO BE ALLOWED FOR THE REIMBURSEMENT EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
