TITLE OF BILL:

An act to amend the environmental conservation law, in relation to
requiring the department of environmental conservation to develop and
propose an appropriation to fund the charge New York drive clean rebate
program

 
PURPOSE:

To make more accessible the ability to purchase electric vehicles by
increasing funding for the charge New York drive clean rebate program.

 
SUMMARY OF PROVISIONS:

Section 1: Describes the conditioned appropriation to fund the charge
drive clean rebate program.

Section 2: Effective Date.

 
JUSTIFICATION:

The state of New York is working to increase access to electric vehicles
as a strategy to reduce greenhouse gas emissions and as a way to meet
the greenhouse gas emission targets codified in the Climate Leadership
and Community Protection Act. Access to electric vehicles at present,
however, is inequitable due to a lack of affordability. To increase
electric vehicle usage and to ensure that access to electric vehicles is
equitable, this bill (1) increases funding for the charge New York drive
clean rebate program, (2) means tests final consumer access to the drive
clean rebate program, and (3) specifies a time frame by which the rebate
program shall phase out absent additional measures to increase the
impact of the drive clean rebate program. This bill will reduce or elim-
inate differences in cost between gasoline-powered motor vehicles and
electric vehicles ensuring all New Yorkers can make the switch to clean-
er modes of transportation

 Introduced  by  Sen. HINCHEY -- read twice and ordered printed, and when
   printed to be committed to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   requiring  the department of environmental conservation to develop and
   propose an appropriation to fund  the  charge  New  York  drive  clean
   rebate program

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 2 of section  19-0306-b  of  the  environmental
 conservation  law  is  amended  by  adding  a new paragraph d to read as
 follows:
   D. AN APPROPRIATION TO FUND THE CHARGE NEW  YORK  DRIVE  CLEAN  REBATE
 PROGRAM.  SUCH APPROPRIATION SHALL BE NO LESS THAN FIFTY MILLION DOLLARS
 PER FISCAL YEAR, AND SUCH APPROPRIATION SHALL REMAIN IN EFFECT AT  LEAST
 UNTIL  THE YEAR TWO THOUSAND TWENTY-SIX. THE DEPARTMENT, IN CONSULTATION
 WITH THE NEW YORK STATE ENERGY RESEARCH AND  DEVELOPMENT  AUTHORITY  AND
 OTHER  INTERESTED PARTIES, SHALL MEANS TEST THE APPROPRIATION. THE UPPER
 LIMIT OF SUCH A MEANS TEST SHALL NOT EXCEED SIXTY-FIVE THOUSAND  DOLLARS
 IN  NET  INCOME  FOR  A SINGLE TAX FILER AND ONE HUNDRED THIRTY THOUSAND
 DOLLARS IN NET INCOME FOR A JOINT FILER. NO  SINGLE  TAX  FILER  AND  NO
 JOINT FILER SHALL RECEIVE A REBATE GREATER THAN FIVE THOUSAND DOLLARS.
   § 2. This act shall take effect immediately.
