 AN ACT to amend  the  public  health  law,  in  relation  to  controlled
   substance disposal kits
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public health law is amended by adding  a  new  section
 291-a to read as follows:
   §  291-A.  CONTROLLED  SUBSTANCE  DISPOSAL  KITS. THE DEPARTMENT SHALL
 CERTIFY CONTROLLED SUBSTANCE DISPOSAL  KITS  TO  BE  INCLUDED  WITH  THE
 PRESCRIPTION  OR  RETAIL  SALE  OF ANY LEGALLY PRESCRIBED SCHEDULE II OR
 SCHEDULE III  CONTROLLED  SUBSTANCE  PURSUANT  TO  SECTION  THIRTY-THREE
 HUNDRED  SIX  OF THIS CHAPTER WHICH IS SOLD AT A PHARMACY. SUCH DISPOSAL
 KITS SHALL PROVIDE CUSTOMERS WITH INFORMATION ON DISPOSAL AND COLLECTION
 OPTIONS FOR SUCH MEDICATIONS AND SHALL BE PROVIDED AT NO CHARGE  TO  THE
 CUSTOMER.
   § 2. This act shall take effect immediately.
