AN ACT providing for the office of temporary and disability assistance
to provide rental assistance to individuals with a loss of ability to
pay rent as a result of COVID-19; and providing for the repeal of such
provisions upon the expiration thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any provision of law to the contrary, for
the duration of the state disaster emergency declared pursuant to execu-
tive order 202 of 2020, and as extended by any future executive order,
the office of temporary and disability assistance may provide singular
instances of rental assistance to individuals who can sufficiently
demonstrate a loss of ability to pay rent as a result of COVID-19. Loss
of ability to pay rent as a result of COVID-19 may be demonstrated by a
certification of risk for eviction from a court of competent jurisdic-
tion, but such certification shall not be a requirement to receive
rental assistance.
§ 2. This act shall take effect immediately, provided that the
provisions of this act shall expire and be deemed repealed on the date
the state disaster emergency declared pursuant to executive order 202 of
2020, and as extended by any future executive order, is lifted; provided
that the commissioner of the office of temporary and disability assist-
ance shall notify the legislative bill drafting commission upon the
lifting of the state disaster emergency declared pursuant to executive
order 202 of 2020, and as extended by any future executive order, in
order that the commission may maintain an accurate and timely effective
data base of the official text of the laws of the state of New York in
furtherance of effectuating the provisions of section 44 of the legisla-
tive law and section 70-b of the public officers law.
