 Introduced  by Sen. MARTUCCI -- read twice and ordered printed, and when
   printed to be committed to the Committee on Health
 
 AN ACT to prohibit the state or political subdivisions from  imposing  a
   mask mandate in schools and daycares and leaving such decisions to the
   local school district, non-public school or daycare
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding any other provision of law, rule, executive
 order, regulation, guidance, determination, or other  directive  to  the
 contrary  by  the  state or any political subdivision thereof, no school
 district, non-public school or  daycare  shall  be  required  to  enact,
 enforce  or  comply  with  any such provision that requires any student,
 teacher or other person to wear a face mask or covering as  a  condition
 for  receiving  any service or entry to any school facilities or daycare
 facilities where the purpose of  such  requirement  is  related  to  the
 COVID-19 virus.
   § 2. This act shall take effect immediately.
