 AN ACT to authorize and direct the  commissioner  of  transportation  to
   transfer  and  convey certain unappropriated state land to the Bedford
   Hills Fire District
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subject to the provisions of this act but notwithstanding
 any other provision of law to the contrary, the commissioner  of  trans-
 portation  is  hereby  authorized and directed to transfer and convey to
 the Bedford Hills Fire District, in consideration of one dollar and upon
 such other consideration as the commissioner may deem proper, the parcel
 of certain lands referenced and described in section two of this act.
   § 2. The lands authorized by section one of this act to be transferred
 and conveyed are as follows:
   ALL that certain lot, piece or parcel  of  land,  situate,  lying  and
 being  in the Town of Bedford, County of Westchester, State of New York,
 being more particularly bounded and described as follows:
   BEGINNING at a point on the northerly boundary line  of  Bedford  Road
 where  the  same is intersected by the division line between Land of the
 People of the Sate of New York, on the west, and property now or former-
 ly belonging to Bedford Hills Fire District, on the east, running thence
 in  generally  southwesterly,  northerly  and  northeasterly   direction
 through Land of the People of the State of New York South 66°58'00" West
 66.53  feet,  on  a  curve to the right having a radius of 21.00 feet, a
 central angle of 137°39'20" for a length of 50.45 feet, North  65°22"40"
 West  2.96  feet  and  North  24°37'20"  East  101.75  feet, thence in a
 northeasterly direction  along  the  southerly  boundary  line  of  land
 belonging  to  Metro  North  - Harlem Division North 61°54'00" East 8.01
 feet, thence in a southerly direction along the westerly  boundary  line
 of  property  now  or  formerly belonging to Bedford Hills Fire District
 South 22°45'40" East 107.96 feet to the point  or  place  of  beginning,
 containing 6,368 Square Feet or 0.1461 Acres, more or less.

   §  3.  The  description  in  section two of this act of the land to be
 conveyed is not intended to be a legal description but  is  intended  to
 identify  the parcel to be conveyed. As a condition of the purchase, the
 Bedford Hills Fire District may submit to the commissioner of  transpor-
 tation,  for  his or her approval, an accurate survey and description of
 the lands to be conveyed, which may be used in the conveyance thereof.
   § 4. The department of transportation shall not transfer or convey the
 aforesaid land unless application in a form acceptable  to  the  commis-
 sioner  of transportation is made to the department of transportation by
 the Bedford Hills Fire District which application must  be  made  within
 one year after the effective date of this act.
   §  5.  Any lands transferred pursuant to this act shall be used by the
 Bedford Hills Fire District for the purposes of constructing  and  main-
 taining  facilities  for  use  by the Bedford Hills Fire District in the
 performance of its duties for said fire district, and  upon  termination
 of such use, title to the lands so transferred shall revert to the state
 of New York.
   § 6. This act shall take effect immediately.
