   when printed to be committed to the Committee on Transportation
 
 AN ACT to amend the vehicle and traffic law, in relation to transferring
   distinctive  license  plates  issued  to  congressional medal of honor
   recipients
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 404-p of the vehicle and traffic law, as added by
 chapter 486 of the laws of 1996, is amended by adding a new  subdivision
 4 to read as follows:
   4.  NOTWITHSTANDING  ANY PROVISION OF LAW TO THE CONTRARY, THE COMMIS-
 SIONER SHALL TRANSFER  A  DISTINCTIVE  PLATE  ISSUED  PURSUANT  TO  THIS
 SECTION  TO  THE  NEXT OF KIN OF A DECEASED CONGRESSIONAL MEDAL OF HONOR
 RECIPIENT IF SUCH NEXT OF KIN SO REQUESTS WITHIN ONE HUNDRED EIGHTY DAYS
 FOLLOWING THE DEATH OF SUCH CONGRESSIONAL MEDAL OF HONOR  RECIPIENT,  OR
 WITHIN ONE HUNDRED EIGHTY DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION
 WHERE  SUCH  CONGRESSIONAL  MEDAL  OF  HONOR  RECIPIENT PREDECEASED SUCH
 EFFECTIVE DATE.  AS USED IN THIS SUBDIVISION "NEXT OF KIN" SHALL MEAN  A
 PERSON'S  CLOSEST  LIVING  BLOOD  RELATIVE, INCLUDING SPOUSE AND ADOPTED
 FAMILY MEMBERS. THE COMMISSIONER SHALL PROMULGATE  ANY  RULES  OR  REGU-
 LATIONS NECESSARY TO CARRY OUT THE PROVISIONS OF THIS SUBDIVISION.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal of any rule or regulation necessary  for  the  implementation  of
 this  act  on its effective date are authorized to be made and completed
 on or before such effective date.

 AN  ACT to amend the vehicle and traffic law, in relation to distinctive
   license plates issued to congressional medal of honor recipients

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 404-p of the vehicle and traffic law, as added by
 chapter 486 of the laws of 1996, subdivision 3 as amended by chapter 415
 of the laws of 2001, is amended to read as follows:
   § 404-p. Distinctive plates for congressional medal of  honor  recipi-
 ents.  1.  Any  congressional  medal of honor recipient residing in this
 state, OR THE SPOUSE OF ANY   SUCH RECIPIENT, shall,  upon  request,  be
 issued a license plate bearing the words "congressional medal of honor".
 Application  for said license plate shall be filed with the commissioner
 in such form and detail as the commissioner shall prescribe.
   2. The distinctive plate authorized herein shall be issued upon proof,
 satisfactory to the commissioner, that the applicant is a  congressional
 medal of honor recipient.
   3. A distinctive plate issued pursuant to this section shall be issued
 in  the  same  manner as other number plates, provided, however, that no
 registration fee or service charge shall be charged for such plate.   NO
 REGISTRATION  FEE  OR  SERVICE CHARGE SHALL BE CHARGED FOR PLATES TRANS-
 FERRED TO A SURVIVING SPOUSE, PURSUANT TO THE PROVISIONS OF  SUBDIVISION
 FOUR OF THIS SECTION.
   4.  NOTWITHSTANDING  ANY PROVISION OF LAW TO THE CONTRARY, THE COMMIS-
 SIONER SHALL TRANSFER  A  DISTINCTIVE  PLATE  ISSUED  PURSUANT  TO  THIS
 SECTION  TO  THE  SURVIVING  SPOUSE OF A DECEASED CONGRESSIONAL MEDAL OF
 HONOR RECIPIENT IF SUCH SURVIVING SPOUSE SO REQUESTS WITHIN ONE  HUNDRED
 EIGHTY  DAYS  FOLLOWING  THE  DEATH OF SUCH CONGRESSIONAL MEDAL OF HONOR
 RECIPIENT, OR WITHIN ONE HUNDRED EIGHTY DAYS OF THE  EFFECTIVE  DATE  OF
 THIS  SUBDIVISION  WHERE  SUCH  CONGRESSIONAL  MEDAL  OF HONOR RECIPIENT
 PREDECEASED SUCH EFFECTIVE DATE.  THE COMMISSIONER SHALL PROMULGATE  ANY
