TITLE OF BILL:

An act to amend the education law, in relation to required training for
school district officers

 
PURPOSE:

To ensure that New York's school board members receive regular training
at the beginning of their terms on updated laws, rules, and regulations,
as well as any changes to state learning standards.

 
SUMMARY OF PROVISIONS:

Section 1: Amends subdivision 1 of section 2102-a of the education law
to implement regular training requirements for trustees or voting
members of school boards in the state to cover the state's updating
learning standards and any new or updated laws, rules, or regulations,
and to remove the waiving of future trainings upon initial completion.

Section 2: Sets the effective date.

 
JUSTIFICATION:

New school board officials currently receive training on their important
work, including financial oversight, fiduciary responsibilities, and the
powers, functions, and duties of boards of education. Upon completion of
that training in their first term, no further training is required of
school board members, many of whom serve their districts for many terms.
This leaves a gap in the information school board officials may have
formally received, as the state's regulations, rules, laws, and learning
standards change over time. This legislation takes a common-sense step
to address that gap by ensuring that such training will cover such
updates as mentioned above and will occur for each school board official
in the first year of their first term and regularly afterward as their
service continues.

 AN ACT to amend the education law, in relation to required training  for
   school district officers
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 1 of section 2102-a of the  education  law,  as
 amended  by  chapter  388  of  the  laws  of 2010, is amended to read as
 follows:
   1. a. Every trustee or voting member of a  board  of  education  of  a
 school  district or a board of cooperative educational services, elected
 or appointed for a term beginning on or after July first,  two  thousand
 five,  shall, within the first year of his or her term, complete a mini-
 mum of six hours of training on the financial oversight,  accountability
 and fiduciary responsibilities of a school board member.
   b.  In addition to the training required by paragraph a of this subdi-
 vision, every trustee or voting member of a  board  of  education  of  a
 school  district or a board of cooperative educational services, elected
 or appointed for a [first] term beginning on or after the first of  July
 next  succeeding the effective date of this paragraph, shall, within the
 first year of his or her term, complete a training  course  to  acquaint
 him or her with the powers, functions and duties of boards of education,
 INCLUDING, BUT NOT LIMITED TO, RESPONSIBILITY FOR ADOPTION OF CURRICULUM
 AND  INSTRUCTIONAL  MATERIALS  FOR  COURSES OF STUDY REQUIRED UNDER THIS
 CHAPTER, AND RESPONSIBILITY FOR ADOPTION OF CURRICULUM AND INSTRUCTIONAL
 MATERIALS ALIGNED WITH ALL NEW YORK STATE LEARNING STANDARDS, as well as
 the powers and duties of other governing and administrative  authorities
 affecting  public  education.  SUCH  TRAINING  SHALL  INCLUDE ANY NEW OR
 UPDATED LAWS, RULES OR REGULATIONS RELEVANT TO THE REQUIREMENTS OF  THIS
 SUBDIVISION.
   c.  [Upon demonstration of compliance, no trustee or member of a board
 of education or a board of cooperative  educational  services  shall  be
 required  to repeat the training requirements provided for in paragraphs
 a and b of this subdivision.] Nothing in this section shall be deemed to

 require a member of a central high school district board or a member  of
 a  board  of  cooperative educational services to complete such require-
 ments if such member has already completed such requirements as a member
 of  a  board  of  a  component school district. [Nothing in this section
 shall be deemed to require trustees or voting  members  of  a  board  of
 education  of  a  school  district or a board of cooperative educational
 services to complete the requirements of paragraph b of this subdivision
 if such trustee or member is seated or appointed on or before the effec-
 tive date of the chapter of the laws of two thousand  ten  that  amended
 this subdivision.]
   § 2. This act shall take effect immediately.
