TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to requiring
that a certain amount of handicapped parking spaces at certain shopping
centers or facilities are equipped with electric vehicle charging
stations

 
PURPOSE OF THE BILL:

This legislation would require a shopping center with more than 100 off
street parking spaces to dedicate parking for handicapped spaces
equipped with electric vehicle charging stations.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 adds a new subdivision 2-a to Section 1203-c of the vehicle
and traffic law to require a shopping center or facility covered by
subdivision one, which has more than 100 off street parking spaces, to
dedicate at least 1% or five spaces whichever is less as handicapped
              

space that is equipped with an electric vehicle charging station avail-
able for public use.

Section 2 is the effective date.

 
JUSTIFICATION:

As New York sees an increase in the number of electric vehicles on the
road, we must take into consideration those EVs that are driven by indi-
viduals with a handicapped parking permit. Current EV charging stations
are often far from entrances to locations, and are not designed to be
ADA compliant with enough room for accessible access. This legislation
seeks to address this issue to require certain shopping areas to install
handicapped parking with a charging station attached. This is common
sense legislation aimed at moving the discussion forward and assisting
individuals have easier and more readily available access to EV charging
locations.

EFFECTIVE DATE:
This act shall take effect in 180 days.
