TITLE OF BILL:
An act to amend the vehicle and traffic law, in relation to fees charged
to certain motorists
PURPOSE:
To assign a fee to drivers with vehicles with license plates from States
which have enacted legislation that allow the drivers of those vehicles
the ability to skirt New York City traffic laws which utilize technology
that prevents accidents and saves lives.
SUMMARY OF PROVISIONS:
Section 1 adds a new Section 516-C to the Vehicle and Traffic Law
authorizing the New York City Department of Transportation ("DOT") to
impose a $50 fee on vehicles entering NYC that display license plates
from a State which does not provide information related to drivers
licensed from that State for the purpose of imposing fines or penalties

AN ACT to amend the vehicle and traffic law, in relation to fees charged
to certain motorists
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The vehicle and traffic law is amended by adding a new
section 516-c to read as follows:
§ 516-C. NON-COOPERATION FEES. THE NEW YORK CITY COMMISSIONER OF
TRANSPORTATION IS AUTHORIZED TO IMPOSE A FEE OF FIFTY DOLLARS ON ANY
VEHICLE ENTERING THE CITY OF NEW YORK WHICH DISPLAYS A LICENSE PLATE
FROM A STATE WHICH DOES NOT PROVIDE OR EXCHANGE REASONABLY NECESSARY
INFORMATION RELATED TO DRIVERS LICENSED BY SUCH STATE FOR THE PURPOSE OF
PERMITTING THE IMPOSITION OF FINES OR PENALTIES FOR TRAFFIC INFRACTIONS,
INCLUDING LIABILITY IMPOSED THROUGH THE USE OF A TRAFFIC CONTROL SIGNAL
MONITORING SYSTEM, A SPEED CONTROL DEVICE OR OTHER PHOTO-MONITORING
SYSTEM AUTHORIZED FOR USE IN SUCH CITY TO ENFORCE CERTAIN TRAFFIC
INFRACTIONS.
2. THE NEW YORK CITY DEPARTMENT OF TRANSPORTATION SHALL DETERMINE
WHICH STATES' VEHICLES ARE SUBJECT TO THE FEE AUTHORIZED BY THIS SECTION
AND MAY CONSTRUCT, OPERATE AND MAINTAIN FACILITIES AND EQUIPMENT FOR THE
IDENTIFICATION OF SUCH VEHICLES AND THE COLLECTION OF SUCH FEE.
3. A. THE FEE MAY BE PAID BY THE OPERATOR OF THE VEHICLE IN CASH, OR
BY DEBIT OR CREDIT CARD. IF THE OPERATOR OF THE VEHICLE IS UNABLE TO PAY
THE FEE AT THE POINT OF COLLECTION, THE OPERATOR SHALL PROVIDE INFORMA-
TION TO THE DEPARTMENT OF TRANSPORTATION STAFF INCLUDING THE OPERATOR'S
NAME, ADDRESS AND TELEPHONE NUMBER AND THE VEHICLE LICENSE PLATE NUMBER
SO THAT THE DEPARTMENT MAY BILL THE OPERATOR OF THE VEHICLE FOR THE FEE.
B. THE COMMISSIONER OF THE DEPARTMENT OF TRANSPORTATION OF THE CITY OF
NEW YORK SHALL, IN CONJUNCTION WITH THE COMMISSIONER OF FINANCE AND ANY
OTHER CITY AGENCY, ENTER INTO AT LEAST ONE AGREEMENT WITH A FINANCING
AGENCY OR CARD ISSUER TO PROVIDE FOR THE ACCEPTANCE BY THE CITY OF NEW
YORK OF CREDIT CARDS AS AN ALTERNATE MEANS OF PAYMENT OF THE FEE.
