2021-A8873 (ACTIVE) - Summary

Permits a retail licensee for on-premises consumption to prepare and keep drinks containing alcoholic beverages that have been mixed and emulsified inside a sealed PET vessel, having a capacity of not less than a gallon, which are dispensed via pressurized draft system.

 AN  ACT  to amend the alcoholic beverage control law, in relation to the
   sale of prepared liquor drinks
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  2  of  section 106 of the alcoholic beverage
 control law is amended by adding a new paragraph (c) to read as follows:
   (C) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF  THIS  SUBDIVI-
 SION, A RETAIL LICENSEE FOR ON-PREMISES CONSUMPTION MAY PREPARE AND KEEP
 DRINKS  CONTAINING  ALCOHOLIC BEVERAGES THAT HAVE BEEN MIXED AND EMULSI-
 FIED INSIDE A SEALED PET VESSEL, HAVING A CAPACITY OF NOT  LESS  THAN  A
 GALLON, WHICH ARE DISPENSED VIA PRESSURIZED DRAFT SYSTEM.
   §  2.  This  act shall take effect on the thirtieth day after it shall
