 AN ACT to amend the penal law, in  relation to   establishing the  crime
   of doxing of an individual
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The penal law is amended by adding a new section 240.33  to
 read as follows:
 § 240.33 DOXING OF AN INDIVIDUAL.
   A PERSON IS GUILTY OF DOXING OF AN INDIVIDUAL WHEN HE OR SHE KNOWINGLY
 MAKES  RESTRICTED  PERSONAL  INFORMATION  ABOUT  AN  INDIVIDUAL PUBLICLY
 AVAILABLE:
   1. WITH THE INTENT TO THREATEN, INTIMIDATE, OR INCITE  THE  COMMISSION
 OF A CRIME OF VIOLENCE AGAINST THE INDIVIDUAL; OR
   2. WITH THE INTENT AND KNOWLEDGE THAT THE RESTRICTED PERSONAL INFORMA-
 TION  WILL BE USED TO THREATEN, INTIMIDATE, OR FACILITATE THE COMMISSION
 OF A CRIME OF VIOLENCE AGAINST THE INDIVIDUAL.
   3. FOR THE PURPOSES OF THIS SECTION, "RESTRICTED PERSONAL INFORMATION"
 SHALL MEAN IDENTIFYING INFORMATION REGARDING  AN  INDIVIDUAL,  INCLUDING
 BUT  NOT LIMITED TO NAMES, TELEPHONE NUMBERS, EMAIL ADDRESSES, AND PHYS-
 ICAL OR MAILING ADDRESSES, WHICH THE INDIVIDUAL  HAS  NOT  MADE  READILY
 APPARENT  TO  THE  PUBLIC,  OR  WHICH  THE INDIVIDUAL HAS NOT AUTHORIZED
 ANOTHER PERSON OR ORGANIZATION TO MAKE READILY APPARENT TO THE PUBLIC.
   DOXING OF AN INDIVIDUAL IS A CLASS A MISDEMEANOR.
   § 2. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
