BILL NUMBER: S1783 SPONSOR: SKOUFIS TITLE OF BILL: An act directing the department of health to establish and implement an infection inspection audit and checklist on residential care facilities, nursing homes and long-term care facilities PURPOSE: Requires the Department of Health to establish and implement an infection inspection audit and checklist on residential care facilities, nursing homes and long-term care facilities. Facilities will be required to meet eighty percent of audit evaluation checklist, which will incor- porate core competencies relating to (1) infection control, (2) personal protective equipment, (3) staffing, (4) clinical care, (5) communication, and (6) reporting. Those facili- ties determined to be not in adherence with the inspection control checklist will be subject to a penalty framework established by the Commissioner, including but not limited to the revocation or suspension

SKOUFIS, MAY, RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT directing the department of health to establish and implement an infection inspection audit and checklist on residential care facili- ties, nursing homes and long-term care facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Definitions. For the purposes of this act, the following terms shall have the following meanings: (a) "Department" means the department of health. (b) "Facility" means a nursing home or residential health care facili- ty as defined in article 28 of the public health law. (c) "Nursing home" means a facility providing therein nursing care to sick, invalid, infirm, disabled or convalescent persons in addition to lodging and board or health-related service, or any combination of the foregoing, and in addition thereto, providing nursing care and health- related service, or either of them, to persons who are not occupants of the facility. (d) "Audit" means the infection control competency audit created by the department under this act. (e) "Checklist" means the infection control competency audit checklist created by the department under this act. § 2. Establishing the infection control competency audit. (a) The department shall promulgate rules and regulations establishing an infection control competency audit for a facility consistent with the provisions of this act. The audit shall include a competency checklist which incorporates specific core competencies based on guidance set forth in this act. (b) The department shall commence audits of facilities on and after October 1, 2021 and such audits shall be conducted on an annual basis thereafter. The public health law is amended by adding a new section 2803-aa to read as follows: § 2803-AA. NURSING HOME INFECTION CONTROL COMPETENCY AUDIT. 1. THE COMMISSIONER SHALL ESTABLISH IN THE DEPARTMENT A PROGRAM FOR AUDITS OF NURSING HOMES TO MEASURE SPECIFIC CORE COMPETENCIES RELATING TO INFECTION CONTROL OF EACH NURSING HOME. THE AUDITS SHALL COMMENCE ON OCTOBER 1, 2021, AND SHALL BE CONDUCTED ANNUALLY THEREAFTER. 2. (A) THE AUDIT SHALL UTILIZE A CHECKLIST TO EVALUATE INFECTION CONTROL COMPETENCY OF EACH NURSING HOME. (B) A NURSING HOME MEETING AT LEAST EIGHTY-FIVE PERCENT OF THE CRITE- RIA ON THE CHECKLIST SHALL BE SCORED AS "PROFICIENT" IN INFECTION CONTROL COMPETENCY. (C) IF A NURSING HOME MEETS BETWEEN SIXTY PERCENT AND EIGHTY-FOUR PERCENT OF THE REQUIRED CRITERIA WITHIN THE CHECKLIST, THE NURSING HOME WILL BE SCORED AS "PROFICIENCY PENDING REINSPECTION." SUCH NURSING HOME WILL BE AUDITED BY THE DEPARTMENT AT LEAST ONCE BEFORE THE NEXT ANNUAL INSPECTION.
