TITLE OF BILL:

An act to amend the state finance law, in relation to requiring the
construction of certain parking facilities to be capable of supporting
electric vehicle charging stations

 
PURPOSE:

This legislation requires any parking garage or parking lot capable of
accommodating fifty or more cars that receives state capital funding to
include in it.

 
SUMMARY OF PROVISIONS:

Section 1 requires any parking garage or parking lot capable of accommo-
dating fifty or more cars that receives state capital funding to be
capable of supporting electric vehicle charging stations. Specifically
requires the electrical raceway and all components be up to all applica-

ble code. Specifically it shall provide a minimum 3.1 kW of electrical
capacity to each charging station when connected. This specifies that
there no is mandate to install the electrical charging stations itself,
but just to install the infrastructure necessary for future charging
stations.

Section 2 is the effective date.

 
JUSTIFICATION:

As New York embarks on its impressive and necessary climate goals, we
must look at ways to increase capacity for those individuals who seek to
purchase and use electric vehicles. One of the major complaints from
electric car owners is the lack of public charging stations available to
them. This legislation seeks to address this concern by requiring enti-
ties that receive state capital funding to install the infrastructure
necessary for electric car charging stations. This legislation does not
mandate the installation of the stations themselves but to be forward
thinking in requiring the installation of the infrastructure. It is
significantly more costly to install the necessary infrastructure for
charging stations after the completion of a parking garage or lot, by
requiring this to be done up front significant cost savings can be real-
ized.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The state finance law is amended by adding  a  new  section
 19-a to read as follows:
   §  19-A.  PARKING  FACILITIES;  SUPPORT  FOR ELECTRIC VEHICLE CHARGING
 STATIONS.  1. FOR PURPOSES OF THIS SECTION  THE  TERM  "PARKING  GARAGE,
 OPEN  PARKING  LOT  AND/OR  OTHER PARKING FACILITY" SHALL MEAN A PARKING
 FACILITY OF MORE THAN FIFTY PARKING SPACES.
   2. ANY CONSTRUCTION PROJECT UNDERTAKEN IN  THIS  STATE  THAT  RECEIVES
 STATE  CAPITAL  FUNDING AND THE SCOPE OF SUCH PROJECT INCLUDES A PARKING
 GARAGE SHALL BE CAPABLE OF SUPPORTING ELECTRIC VEHICLE CHARGING STATIONS
 THROUGH AN ELECTRICAL RACEWAY TO THE ELECTRIC SUPPLY PANEL  SERVING  THE
 GARAGE  THAT  SHALL BE CAPABLE OF PROVIDING A MINIMUM OF 3.1 KW OF ELEC-
 TRICAL CAPACITY TO EACH CHARGING STATION CONNECTED TO IT WITH THE  RACE-
 WAY.  SUCH RACEWAY AND ALL COMPONENTS AND WORK APPURTENANT THERETO SHALL
 BE IN ACCORDANCE WITH STATE, CITY AND MUNICIPAL ELECTRICAL CODES.
   3. ANY CONSTRUCTION PROJECT UNDERTAKEN IN  THIS  STATE  THAT  RECEIVES
 STATE  CAPITAL  FUNDING  AND  THE SCOPE OF SUCH PROJECT INCLUDES AN OPEN
 PARKING LOT AND OTHER PARKING FACILITY SHALL BE  CAPABLE  OF  SUPPORTING
 ELECTRIC  VEHICLE  CHARGING  STATIONS  THROUGH AN ELECTRICAL RACEWAY, NO
 SMALLER THAN ONE INCH, CAPABLE OF PROVIDING A MINIMUM SUPPLY OF 11.5 KVA
 TO AN ELECTRIC VEHICLE SUPPLY EQUIPMENT (EVSE) FROM AN  ELECTRIC  SUPPLY
 PANEL.  THE  ELECTRIC SUPPLY PANEL SERVING SUCH PARKING SPACES MUST HAVE
 AT LEAST  3.1  KW  OF  AVAILABLE  CAPACITY  FOR  EACH  CHARGING  STATION
 CONNECTED  TO  IT WITH THE RACEWAY.  SUCH RACEWAY AND ALL COMPONENTS AND

PURPOSE:

This legislation requires any parking garage or parking lot capable of
accommodating fifty or more cars that receives state capital funding to
include in it.

 
SUMMARY OF PROVISIONS:

Section 1 requires any parking garage or parking lot capable of accommo-
dating fifty or more cars that receives state capital funding to be
capable of supporting electric vehicle charging stations at a minimum of
twenty percent of available parking spaces. Specifically requires the

electrical raceway and all components be up to all applicable code.
Specifically it shall provide a minimum of forty amps and two hundred
volts of electrical capacity to each charging station when connected.
This specifies that there no is mandate to install the electrical charg-
ing stations itself, but just to install the infrastructure necessary
for future charging stations. Further, this section states that
construction or development of these projects shall comply with Article
8 of the Labor Law, including the payment of prevailing wage.

Section 2 amends section 224-a of the labor law to add language that any
project undertaken pursuant to section 19-a of the state finance law
shall be considered a covered project and shall be subject to prevailing
wage requirements.

Section 3 is the effective date.

As New York embarks on its impressive and necessary climate goals, we
must look at ways to increase capacity for those individuals who seek to
purchase and use electric vehicles. One of the major complaints from
electric car owners is the lack of public charging stations available to
them. This legislation seeks to address this concern by requiring enti-

   §  2. Section 224-a of the labor law is amended by adding a new subdi-
 vision 4-a to read as follows:
   4-A. FOR PURPOSES OF THIS SECTION,  ANY  CONSTRUCTION  OR  DEVELOPMENT
 PROJECT  UNDERTAKEN  PURSUANT  TO  SECTION 19-A OF THE STATE FINANCE LAW
 SHALL BE CONSIDERED A "COVERED PROJECT" AND  SHALL  BE  SUBJECT  TO  THE
 PREVAILING WAGE REQUIREMENTS IN ACCORDANCE WITH THIS ARTICLE.
   §  3.  This act shall take effect immediately; provided, however, that
 section two of this act shall take effect on the same date  and  in  the
 same  manner as section 1 of part FFF of chapter 58 of the laws of 2020,
 takes effect.

DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION:

Added a definition of construction project for the purposes of this
bill; set parameters for applicable parking facilities which include
between fifty and two hundred parking spaces and over two hundred park-
ing spaces to be capable of supporting electric vehicle charging
stations for a minimum of ten percent of available spaces and a minimum
of twenty percent, respectively; and made conforming and technical
changes to language.
