TITLE OF BILL:

An act to amend the agriculture and markets law, in relation to estab-
lishing the "New York state animal and plant fiber program"

 
PURPOSE:

The purpose of this bill is to expand the state's existing Grown and
Certified Program to include animal and plant fiber, such as sheep's
wool and hemp, as a new category of product eligible for such seal of
certification.

 
SUMMARY OF PROVISIONS:

The agriculture and markets law is amended by adding a new article 25-c
named New York State Animal and Plant Fiber Program and the commissioner
is directed to create such program within the New York Grown and Certi-
fied Program. The program will give producers of animal and plant fibers

the opportunity to apply for permission to use the Grown and Certified
seal on labels, packaging and advertisements for the products. Animal
and plant fibers are defined as those used to create textile products
and include sheep's wool, llama and alpaca and goat fiber, as well as
plants such as cotton and hemp.

The commissioner is authorized to promulgate rules and regulations
necessary to establish the program. The department will create educa-
tional materials and make them available on their website and distribute
same to Cornell Cooperative Extensions, Boards of cooperative educa-
tional services4-H development groups, organizers of county fairs, and
any other farming advocacy group deemed appropriate.  The animal and
plant fiber program would be introduced by the department at the upcom-
ing state fair.

 
JUSTIFICATION:

New York is uniquely positioned as one of only two states in the country
where it is possible to build a full scale and commercially viable farm-
to-fabric supply chain, and our textile manufacturers are eager to show-
case their high-quality products. The Grown and Certified Program has
helped elevate the market opportunities and consumer appeal for many New
York products ranging from cheese, to maple products, to beverages and
even Christmas trees and cut flowers. While consumers increasingly value
the opportunity to purchase local products, the Grown and Certified
Program has not yet offered its seal of exceptional quality to products
made of the fiber of animals or plants, such as sheep's wool clothing or
hemp-derived textiles. The boom in industrial hemp and the growing
interest in sheep and alpaca farming are trends we should reward and
encourage, and the new opportunity this bill affords textile producers
will also enhance connections between New York growers, processors, and
producers of finished items.

By expanding the Grown and Certified Program to animal and plant fiber
producers, New York will be able to showcase the exceptional quality of
this category of home-grown products and further boost its own agribusi-
ness entrepreneurs.

 AN ACT to amend the agriculture and markets law, in relation  to  estab-
   lishing the "New York state animal and plant fiber program"
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The agriculture and markets law is amended by adding a  new
 article 25-C to read as follows:
                               ARTICLE 25-C
               NEW YORK STATE ANIMAL AND PLANT FIBER PROGRAM
 SECTION 340. NEW YORK STATE ANIMAL AND PLANT FIBER PROGRAM.
         341. DEFINITIONS.
   §  340.  NEW YORK STATE ANIMAL AND PLANT FIBER PROGRAM. 1. THE COMMIS-
 SIONER SHALL CREATE A "NEW YORK STATE ANIMAL AND  PLANT  FIBER  PROGRAM"
 WHICH SHALL BE A PART OF THE NEW YORK GROWN AND CERTIFIED PROGRAM.
   2.  THE  PROGRAM SHALL INCLUDE THE OPPORTUNITY FOR PRODUCERS OF ANIMAL
 FIBERS AND PLANT FIBERS IN NEW YORK STATE TO  APPLY  FOR  PERMISSION  TO
 PLACE  THE  NEW YORK STATE GROWN AND CERTIFIED SEAL, ON OR UPON A LABEL,
 LABELING, PACKAGE, OR CONTAINER OF, OR ON OR UPON  AN  ADVERTISEMENT  OR
 DISPLAY  PROMOTING, PRODUCTS QUALIFYING FOR USE OF THE SEAL. SUCH APPLI-
 CATION SHALL BE SUBMITTED TO THE COMMISSIONER, UPON A FORM  PROVIDED  BY
 THE  COMMISSIONER,  AND  SHALL  CONTAIN  THE  INFORMATION WHICH SHALL BE
 REQUIRED PURSUANT TO RULES AND/OR REGULATIONS  PROMULGATED  PURSUANT  TO
 THIS SECTION.
   3.  THE COMMISSIONER SHALL PROMULGATE ANY FURTHER RULES OR REGULATIONS
 HE OR SHE SHALL DEEM NECESSARY FOR THE ESTABLISHMENT  AND  INCORPORATION
 OF THE PROGRAM WITHIN THE NEW YORK STATE GROWN AND CERTIFIED PROGRAM.
   4.  THE DEPARTMENT SHALL CREATE EDUCATIONAL MATERIALS FOR THE PROGRAM,
 WHICH THE DEPARTMENT SHALL MAKE  AVAILABLE  ON  ITS  WEBSITE  AND  SHALL
 DISTRIBUTE SUCH EDUCATIONAL MATERIALS, BOTH ELECTRONICALLY AND IN PRINT,
 TO:

   (A) CORNELL COOPERATIVE EXTENSIONS, ESTABLISHED BY CORNELL UNIVERSITY;
   (B) BOARDS OF COOPERATIVE EDUCATIONAL SERVICES;
   (C)  THE  NATIONAL  4-H YOUTH DEVELOPMENT ORGANIZATION ADMINISTERED BY
 THE NATIONAL INSTITUTE OF FOOD AND AGRICULTURE;
   (D) ORGANIZERS OF COUNTY FAIRS IN NEW YORK STATE; AND
   (E) ANY FARMING ADVOCACY GROUPS THE COMMISSIONER SHALL DEEM  APPROPRI-
 ATE.
   5. THE PROGRAM SHALL BE INTRODUCED BY THE DEPARTMENT AT THE STATE FAIR
 HELD  PURSUANT  TO  ARTICLE  TWO-A  OF THIS CHAPTER, NEXT SUCCEEDING THE
 EFFECTIVE DATE OF THIS SECTION.
   § 341. DEFINITIONS. FOR THE PURPOSES OF THIS  ARTICLE,  THE  FOLLOWING
 TERMS SHALL HAVE THE FOLLOWING MEANINGS:
   1.  THE  "NEW  YORK  STATE  ANIMAL  AND  PLANT  FIBER PROGRAM" OR "THE
 PROGRAM" MEANS THE NEW YORK STATE ANIMAL AND PLANT FIBER PROGRAM  ESTAB-
 LISHED PURSUANT TO SECTION THREE HUNDRED FORTY OF THIS ARTICLE.
   2.  "ANIMAL FIBER" MEANS NATURAL FIBERS THAT ARE OBTAINED FROM ANIMALS
 INCLUDING, BUT NOT LIMITED TO HAIR, FUR, OR  SKIN  SECRETIONS  THAT  ARE
 SPUN, WOVEN, OR OTHERWISE MANIPULATED TO CREATE TEXTILE PRODUCTS.
   3.  "PLANT  FIBER"  MEANS NATURAL FIBERS THAT ARE OBTAINED FROM PLANTS
 AND USED TO CREATE TEXTILE  PRODUCTS  INCLUDING,  BUT  NOT  LIMITED  TO,
 COTTON AND HEMP.
   4.  THE "NEW YORK STATE GROWN AND CERTIFIED PROGRAM" MEANS THE PROGRAM
 ESTABLISHED PURSUANT TO PART ONE HUNDRED SIXTY-ONE OF TITLE ONE  OF  THE
 NEW YORK STATE CODES, RULES AND REGULATIONS.
   5.  THE  "NEW  YORK  GROWN AND CERTIFIED SEAL" OR "THE SEAL" MEANS THE
 SEAL CREATED BY THE COMMISSIONER PURSUANT TO SECTION 161.4 OF  PART  ONE
 HUNDRED  SIXTY-ONE  OF  TITLE ONE OF THE NEW YORK STATE CODES, RULES AND
 REGULATIONS.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have  become  a  law.    Effective  immediately, the addition, amendment
 and/or repeal of any rule or regulation necessary for the implementation
 of this act on  its  effective  date  are  authorized  to  be  made  and
 completed on or before such effective date.

SUMMARY OF PROVISIONS:

Section 16 of the agriculture and markets law is amended by adding a new
subdivision 2-g directing the department, in cooperation with the
department of economic development, to assist in the promotion, market-
ing and sale, both within and outside the state, animal and plant fiber
and products made from such fiber. The program will give producers of
animal and plant fibers the opportunity to apply for permission to use
the Grown and Certified seal on labels, packaging and advertisements for
the products. Animal fibers are defined as natural fibers that have
formed the covering, or fleece, of sheep or other hairy animals such as
goats or alpacas, shorn for the purpose of creating textile products.

Plant fibers means natural fibers that are obtained from plants like
hemp and are used to create textile products.  The department will also
develop educational materials about animal and plant fiber, especially
for young people, in cooperation with cooperative extension, boards of
cooperative educational services, local fairs, and the state fair.

 
JUSTIFICATION:

The Grown and Certified Program has helped elevate the market opportu-

 FIBER.   FOR THE PURPOSES OF THIS SUBDIVISION ANIMAL FIBER MEANS NATURAL
 FIBERS THAT HAVE FORMED THE COVERING, OR FLEECE, OF SHEEP OR OTHER HAIRY
 ANIMALS SUCH AS GOATS OR ALPACAS, SHORN FOR  THE  PURPOSES  OF  CREATING
 TEXTILE PRODUCTS, AND PLANT FIBER MEANS NATURAL FIBERS THAT ARE OBTAINED
 FROM  PLANTS  AND  USED  TO  CREATE  TEXTILE PRODUCTS INCLUDING, BUT NOT
 LIMITED TO, HEMP. SUCH AID SHALL INCLUDE, BUT NOT BE LIMITED TO:
   (A) THE OPPORTUNITY FOR PRODUCERS OF ANIMAL AND PLANT  FIBERS  IN  THE
 STATE  TO  PARTICIPATE IN PROGRAMS THAT OFFER SEALS OR LOGOS IDENTIFYING
 SUCH FIBERS AS GROWN IN NEW YORK STATE AND CERTIFIED FOR THEIR  QUALITY,
 FOR PRODUCT LABELING, ADVERTISING, AND DISPLAYS; AND
   (B)  THE  DEVELOPMENT  OF EDUCATIONAL MATERIALS ABOUT ANIMAL AND PLANT
 FIBER, ESPECIALLY FOR YOUNG  PEOPLE,  IN  COOPERATION  WITH  COOPERATIVE
 EXTENSION,  BOARDS OF COOPERATIVE EDUCATIONAL SERVICES, LOCAL FAIRS, AND
 THE STATE FAIR.
   § 2. This act shall take effect immediately.
