BILL NUMBER: S4350 SPONSOR: GOUNARDES TITLE OF BILL: An act relating to establishing Angelina Liu as the genetic child and distributee of Wenjian Liu for purposes of the estates, powers and trusts law PURPOSE OR GENERAL IDEA OF BILL: To amend the Estates, Powers and Trusts Law (EPTL) to establish that Angelina Liu shall be considered the genetic child of Wenjian Liu for purposes of intestate succession SUMMARY OF PROVISIONS: Section 1 of the bill provides that Angelina Liu shall be considered the genetic child and distributee of Wenjian Liu despite any provisions of section 4-1.3 of EPTL to the contrary.

GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT relating to establishing Angelina Liu as the genetic child and distributee of Wenjian Liu for purposes of the estates, powers and trusts law THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provisions of section 4-1.3 of the estates, powers and trusts law to the contrary, Angelina Liu shall be considered the genetic child, as such term is described in paragraph 3 of subdivision (a) of section 4-1.3 of the estates, powers and trusts law, of Wenjian Liu, for the purposes of article 4 of such law. Angeli- na Liu shall be considered a distributee of Wenjian Liu and included in any disposition of property to persons described in any instrument as the issue, children, descendants, heirs, heirs at law, next of kin, distributees (or by any like import) of Wenjian Liu. § 2. Notwithstanding any provisions of section 4-1.3 of the estates, powers and trusts law to the contrary, Angelina Liu shall be considered the genetic child of Wenjian Liu, for the purposes of article four of such law. Angelina Liu shall be considered a distributee of Wenjian Liu and included in any disposition of property to persons described in any instrument as the issue, children, descendants, heirs, heirs at law, next of kin, distributees (or by any like import) of Wenjian Liu. § 3. This act shall take effect immediately and shall apply to estates of decedents dying on or after November 21, 2014; provided however, that section two of this act shall take effect on the same date and in the same manner as part L of chapter 56 of the laws of 2020, takes effect. Notwithstanding any provisions of section 4-1.3 of the estates, powers and trusts law to the contrary, Angelina Liu, daughter of Peixa Xia Chen and residing at 1479 East 79th Street in Brooklyn, New York, 11236, shall be considered the genetic child of Wenjian Liu, for the purposes of article four of such law. Angelina Liu shall be consid- ered a distributee of Wenjian Liu and included in any disposition of property to persons described in any instrument as the issue, children, descendants, heirs, heirs at law, next of kin, distributees (or by any like import) of Wenjian Liu. § 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on or after December 14, 2014.
