BILL NUMBER: S4784 SPONSOR: MAYER TITLE OF BILL: An act to amend the real property law, in relation to allowing acknowl- edgments and proofs by any commissioned officer in active service authorized to act as a notary PURPOSE OR GENERAL IDEA OF BILL: The conform the individuals authorized by New York law to perform notary services for armed service members with the federal laws and regulations granting individuals authority to perform notary services for armed service members. SUMMARY OF SPECIFIC PROVISIONS: Section 1 grants those individuals authorized to perform notary services for members of the armed services the ability to do so under New York law.

MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the real property law, in relation to allowing acknowl- edgments and proofs by any commissioned officer in active service authorized to act as a notary THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of section 300 of the real property law, as amended by chapter 977 of the laws of 1962, is amended to read as follows: The acknowledgment or proof of a conveyance of real property situate in this state, if made by a person enlisted or commissioned in or serv- ing in or with the armed forces of the United States or by a dependent of any such person, wherever located, or by a person attached to or accompanying the armed forces of the United States, whether made within or without the United States, may be made before any commissioned offi- cer in active service of the armed forces of the United States [with the rank of second lieutenant or higher in the Army, Air Force or Marine Corps, or ensign or higher in the Navy or Coast Guard, or with equiv- alent rank] AUTHORIZED TO ACT AS A NOTARY in any [other] component part of the armed forces of the United States. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD08749-01-1
