TITLE OF BILL:

An act to amend the labor law, in relation to notifying individuals
applying for and receiving unemployment benefits of rental assistance
and mortgage assistance programs

 
PURPOSE:

This bill would require the Department of Labor to notify and provide
information to applicants for unemployment insurance regarding rental
and mortgage assistance programs available by New York State. The infor-
mation would also be provided upon every recertification of unemployment
insurance and would retroactively include those applying for benefits
from March 1, 2020 and thereafter.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1: The Commissioner of Labor shall provide a notice to each

individual filing a new claim for unemployment benefits and each time an
individual recertifies for such benefits informing the individual of
rental assistance and mortgage assistance programs available through the
division of housing and community renewal and other state agencies. The
Commissioner shall also provide a link to such programs on the depart-
ment's website. Such link shall be prominently displayed and easily
accessible by individuals seeking unemployment benefits.

Section 2: Effective Date

 
JUSTIFICATION:

It is imperative that people reaching out for assistance because they
have lost their jobs are also provided with other assistance programs
that are designed to help keep people in their homes. We also have an
interest as a state to be integrated in our approach to connect people
with services that will mitigate the situation when people find them-
selves jobless, especially through no fault of their own as we have seen
throughout the COVID-19 pandemic. This legislation will better help
people navigate several assistance programs during a challenging time
for them and their families.

EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that the
notice of rental assistance and mortgage assistance programs required

2020.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The labor law is amended by adding a new section 596-a to
 read as follows:
   § 596-A.  NOTIFICATION OF RENTAL ASSISTANCE  AND  MORTGAGE  ASSISTANCE
 PROGRAMS.    THE  COMMISSIONER SHALL PROVIDE A NOTICE TO EACH INDIVIDUAL
 FILING A NEW CLAIM FOR UNEMPLOYMENT BENEFITS AND EACH TIME AN INDIVIDUAL
 RECERTIFIES FOR SUCH BENEFITS INFORMING THE INDIVIDUAL OF RENTAL ASSIST-
 ANCE AND MORTGAGE ASSISTANCE PROGRAMS AVAILABLE THROUGH THE DIVISION  OF
 HOUSING AND COMMUNITY RENEWAL AND OTHER STATE AGENCIES.  THE COMMISSION-
 ER  SHALL  ALSO  PROVIDE  A  LINK  TO  SUCH PROGRAMS ON THE DEPARTMENT'S
 WEBSITE.  SUCH LINK SHALL BE PROMINENTLY DISPLAYED AND EASILY ACCESSIBLE
 BY INDIVIDUALS SEEKING UNEMPLOYMENT BENEFITS.
   § 2. This act shall take effect immediately; provided,  however,  that
 the  notice  of  rental  assistance  and  mortgage  assistance  programs
 required pursuant to section one of this act shall be  provided  to  all

To require the Department of Labor to provide information to unemploy-
ment claimants regarding rental, mortgage, and utility assistance

SUMMARY OF PROVISIONS:

Section one would require the Commissioner of Labor to provide informa-
tion on utility assistance and rental and mortgage assistance programs
available through the Division of Housing and Community Renewal and the
Office of Temporary and Disability Assistance to unemployment insurance

claimants. Such information would also be posted on the Department of
Labor's website.

Section two would establish the effective date.

 
DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSION (IF APPLICABLE):

The amended version moves these provisions into section 540 of the Labor
Law.

 AN  ACT  to  amend  the  labor law, in relation to notifying individuals

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 540 of the labor law, as amended by chapter 601  of
 the laws of 2007, is amended to read as follows:
   §   540.   [Informational   pamphlet]  INFORMATION  about  food  stamp
 [program], UTILITY, AND RENTAL AND  MORTGAGE  ASSISTANCE  PROGRAMS.  The
 commissioner  shall establish procedures whereby each person who files a
 claim for unemployment insurance pursuant to section five hundred  nine-
 ty-six  of this article, shall receive [an informational leaflet] INFOR-
 MATION about the food stamp program provided by the office of  temporary
 and  disability  assistance pursuant to subdivision six of section nine-
 ty-five-a of the social services law  AND  THE  UTILITY  ASSISTANCE  AND
 RENTAL  AND  MORTGAGE ASSISTANCE PROGRAMS AVAILABLE THROUGH THE DIVISION
 OF HOUSING AND COMMUNITY RENEWAL AND THE OFFICE OF TEMPORARY  AND  DISA-
 BILITY ASSISTANCE. THE COMMISSIONER SHALL ALSO PROVIDE INFORMATION ABOUT
 SUCH  PROGRAMS  ON  THE DEPARTMENT'S WEBSITE.  SUCH INFORMATION SHALL BE
 PROMINENTLY DISPLAYED AND EASILY  ACCESSIBLE  BY  INDIVIDUALS  FILING  A
 CLAIM OR CERTIFYING FOR UNEMPLOYMENT BENEFITS.
   § 2. This act shall take effect immediately.
