BILL NUMBER: S5556 SPONSOR: PALUMBO TITLE OF BILL: An act to amend the general municipal law, in relation to local civil administrative enforcement procedures in the town of East Hampton PURPOSE: Relates to local civil administrative enforcement procedures in the town of East Hampton. SUMMARY OF PROVISIONS: Section 1. Subdivision 3 of section 380 of the general municipal law is designated subdivision 4 and a new subdivision 5 is added to authorize the town of East Hampton to adopt a local law establishing an adminis- trative adjudication hearing procedure for all code and ordinance violations relating to conditions which constitute a threat or danger to the public health, safety or welfare, provided, however, that such

THIELE -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to local civil administrative enforcement procedures in the town of East Hampton THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 380 of the general municipal law, as added by chapter 146 of the laws of 2017, is designated subdivision 4 and a new subdivision 5 is added to read as follows: 5. THE TOWN OF EAST HAMPTON MAY ADOPT A LOCAL LAW ESTABLISHING AN ADMINISTRATIVE ADJUDICATION HEARING PROCEDURE UNDER THE PROVISIONS OF THIS ARTICLE FOR ALL CODE AND ORDINANCE VIOLATIONS RELATING TO CONDI- TIONS WHICH CONSTITUTE A THREAT OR DANGER TO THE PUBLIC HEALTH, SAFETY OR WELFARE, PROVIDED, HOWEVER, THAT SUCH ADMINISTRATIVE ADJUDICATION HEARING PROCEDURE SHALL NOT APPLY TO VIOLATIONS OF THE BUILDING CODE OF THE TOWN OF EAST HAMPTON. § 2.
