BILL NUMBER: S566 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the executive law, in relation to extending the statute of limitations for claims resulting from unlawful discriminatory prac- tices constituting sexual harassment to three years PURPOSE: This bill would extend the administrative statute of limitations for any unlawful discrimination practice including sexual harassment from one year to three years. SUMMARY OF PROVISIONS: Section 1 of this bill amends section 297 of the Executive Law by stat- ing any complaint filed pursuant to this section must be so filed within one year after the alleged discriminatory practice, provided that in cases of sexual harassment, the complaint must be so filed within three

Subdivision 5 of section 297 of the executive law, as amended by chapter 160 of the laws of 2019, is amended to read as follows: 5. Any complaint filed pursuant to this section must be so filed with- in [one year] THREE YEARS after the alleged unlawful discriminatory practice. In cases of sexual harassment in employment, any complaint filed pursuant to this section must be so filed within three years after the alleged unlawful discriminatory practices. § 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02708-01-1
