 AN ACT to amend the education law, in relation to advance enrollment  of
   military-connected students
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 18 of section 3302 of  the  education  law,  as
 added  by  section  1  of  part A of chapter 328 of the laws of 2014, is
 amended and a new subdivision 20 is added to read as follows:
   18. "Uniformed service" or "uniformed services" means the Army,  Navy,
 Air  Force, Marine Corps (INCLUDING SPACE FORCE), Coast Guard as well as
 the Commissioned Corps of the National Oceanic and Atmospheric  Adminis-
 tration, and Public Health Services.
   20.  THE TERM "MILITARY-CONNECTED STUDENT" SHALL MEAN A STUDENT WHO IS
 THE DEPENDENT OF EITHER A PERSON IN THE ACTIVE MILITARY SERVICE  OF  THE
 UNITED  STATES  OR  IN  A  FULL TIME STATUS DURING ACTIVE SERVICE WITH A
 FORCE OF THE ORGANIZED MILITIA.
   § 2. The education law is amended by adding a new  section  3304-a  to
 read as follows:
   § 3304-A. MILITARY-CONNECTED STUDENTS; ADVANCE ENROLLMENT.  A MILITAR-
 Y-CONNECTED  STUDENT  WHOSE PARENT OR GUARDIAN IS BEING RELOCATED TO THE
 STATE UNDER MILITARY ORDERS AND IS TRANSFERRED TO OR IS PENDING TRANSFER
 TO A MILITARY INSTALLATION WITHIN THE STATE, SHALL BE  DEEMED  TO  BE  A
 RESIDENT  PUPIL  OF  A  SCHOOL  DISTRICT  FOR THE PURPOSES OF ENROLLMENT
 PURSUANT TO SECTION THREE THOUSAND TWO HUNDRED TWO OF  THIS  TITLE.    A
 SCHOOL DISTRICT SHALL PERMIT MILITARY-CONNECTED STUDENTS TO ENROLL PREL-
 IMINARILY  BY  REMOTE  REGISTRATION WITHOUT CHARGE AND SHALL NOT REQUIRE
 THE PARENTS OR  GUARDIANS  OF  THE  MILITARY-CONNECTED  STUDENT  OR  THE
 STUDENT HIMSELF OR HERSELF TO PHYSICALLY APPEAR AT A LOCATION WITHIN THE
 DISTRICT  TO  REGISTER  THE STUDENT, IF THE PARENTS OR GUARDIANS PRESENT
 EVIDENCE OF MILITARY ORDERS THAT A PARENT OR GUARDIAN WILL BE  STATIONED

 AN  ACT to amend the education law, in relation to advance enrollment of
   certain students

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

 DISTRICT IN WHICH THE STUDENT IS TO BE  ENROLLED.    A  SCHOOL  DISTRICT
 SHALL  PERMIT  A  STUDENT TO ENROLL PRELIMINARILY BY REMOTE REGISTRATION
 WITHOUT CHARGE AND SHALL NOT REQUIRE THE STUDENT OR THE PARENT OR GUARD-
 IAN OF THE STUDENT  TO  PHYSICALLY  APPEAR  AT  A  LOCATION  WITHIN  THE
 DISTRICT FOR THE PURPOSE OF ENROLLING THE STUDENT PROVIDED THE PARENT OR
 GUARDIAN  OF  THE STUDENT PROVIDE A SCHOOL DISTRICT WITH MILITARY ORDERS
 THAT A PARENT OR GUARDIAN WILL BE STATIONED IN  THIS  STATE  DURING  THE
 CURRENT OR FOLLOWING SCHOOL YEAR AND AN ADDRESS WITHIN THE BOUNDARIES OF
 THE DISTRICT IN WHICH THE STUDENT WILL RESIDE AND IS TO BE ENROLLED.
   § 3. This act shall take effect immediately.
