TITLE OF BILL:

An act to amend the public health law, in relation to allowing donate
life registration on electronic application forms administered by the
office of temporary disability assistance, the higher education services
corporation, and on mandatory electronic tax filings

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to provide greater opportunities for people
to become organ donors. This bill requires the inclusion of space for
registering in the donate life registry for organ, eye, and tissue
donations by: the New York State Higher Education Services Corporation
on applications and renewals/recertifications for student aid, grants,
scholarships, end loan programs; the Office of Temporary and Disability
Assistance through certain websites; and by the Department of Taxation
and Finance on certain tax documents subject to electronic filing.

SUMMARY OF PROVISIONS:

Section 1 amends paragraph a of subdivision 5 of section 4310 of the
public health law, and adds the following to the approved opportunities
to make an anatomical gift: student financial aid transactions adminis-
tered by the Higher Education Services Corporation, certain electronic
tax filings administered by the Department of Taxation and Finance, and
transactions administered through certain websites administered by the
Office of Temporary Disability Assistance.

Section 2 amends paragraph b of subdivision 5 of section 4310 of the
public health law, and makes conforming changes to provide that the
Commissioner (f. Health will consult with state agency leadership to
implement changes required for the operationalization of the amendments
in Section 1, as well as any future amendments to subdivision 5 of
section 4310 of the public health law.

Section 3 sets, the effective date of his act.

 
JUSTIFICATION:

While important recent improvements have been made, New York unfortu-
nately continues to struggle regarding the percentage of residents that
are registered as organ and tissue donors. Nearly 9,000 individuals need
a life- saving organ transplant at any given time, which represents one
of the highest needs for donors in the United States. Over 1,500 people
in New York State have been on the national transplant waiting list for
more than five years. Sadly, in 2020 alone, nearly 600 New Yorkers died
in part due to a pronounced shortage of donors.

This legislation takes a commonsense approach to increasing opportu-
nities for New Yorkers to register as organ and tissue donors through he
donate life registry. Where state government forms presenting the public
with the option to register as a donor are currently limited to iden-
tification applications at the Department of Motor Vehicles, voter
registration forms, the state's healthcare exchange, and standalone
forms to participate in the registry, much more can and should be done
to encourage registration.
This bill mandates that additional state-issued transactions must pres-
ent New Yorkers with the opportunity to register as an organ and tissue
donor, including: electronically processed tax filings, applications and
renewals/recertifications for student aid and loan programs provided by
:he New York State Higher Education Services Corporation, and benefits
transactions through certain websites operated by the Office of Tempo-
rary and Disability Assistance.

The legislation will provide millions of New Yorkers from demograph-
ically diverse segments of the population with new and regular opportu-
nities to document their decision to make an anatomical gift upon their
passing. Many of the transactions being proposed are completed on an
annual basis, which will also increase the frequency of engagement on
this vital topic with New Yorkers.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:

EFFECTIVE DATE:
This act shall take effect on the one hundred eightieth day after having
become a law; provided, however, that if chapter 149 of the laws of 2020
have not taken effect on or before such date, then this act shall take
effect on the same date and in the same manner s such chapter of the
laws of 2020 takes effect.

 AN ACT to amend the public health law, in relation  to  allowing  donate
   life  registration on electronic application forms administered by the
   office  of  temporary  disability  assistance,  the  higher  education
   services corporation, and on mandatory electronic tax filings
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraph (a) of subdivision  5  of  section  4310  of  the
 public  health  law,  as  amended by chapter 149 of the laws of 2020, is
 amended to read as follows:
   (a) Such organ, eye and tissue registration  of  consent  to  make  an
 anatomical gift can be made through: (i) indication made on the applica-
 tion  or  renewal  form of a driver's license, (ii) indication made on a
 non-driver identification card application or renewal form, (iii)  indi-
 cation made on a voter registration form pursuant to subdivision five of
 section  5-210 of the election law, (iv) indication made on the applica-
 tion for, OR RENEWAL OF health care coverage offered through  the  state
 health benefit exchange, (v) enrollment through the donate life registry
 website,  (vi)  paper  enrollment submitted to the donate life registry,
 (vii) indication made on the application or renewal form of  a  hunting,
 fishing  or  trapping  license issued pursuant to title seven of article
 eleven of the environmental conservation  law,  [or]  (viii)  INDICATION
 MADE  ON TRANSACTIONS ADMINISTERED BY THE OFFICE OF TEMPORARY DISABILITY
 ASSISTANCE THROUGH THE MYBENEFITS.NY.GOV WEBSITE, OR ANY SUCH  SUCCESSOR
 WEBSITE; (IX) INDICATION MADE ON APPLICATIONS, RENEWALS OR RELATED TRAN-
 SACTIONS  FOR  COLLEGE FINANCIAL AID, GRANTS, OR SCHOLARSHIPS OFFERED OR
 ADMINISTERED THROUGH ANY WEBSITE  MAINTAINED  BY  THE  HIGHER  EDUCATION
 SERVICES  CORPORATION;  (X)  INDICATION MADE ON ANY TAX DOCUMENT THAT IS
 SUBJECT TO MANDATORY ELECTRONIC FILING IN ACCORDANCE WITH THE PROVISIONS
 OF SECTION TWENTY-NINE OF THE TAX LAW; OR (XI) through any other  method

 identified  by  the commissioner. The department shall establish a means
 by which to register the consent given by individuals who are sixteen or
 seventeen years of age in the  donate  life  registry,  and  shall  make
 registration  available  by any of the methods provided in subparagraphs
 (i), (ii), (iii), (iv), (v), (vi), (vii) [and], (VIII), (IX) AND (X)  of
 this paragraph.
   §  2.  Subparagraph  (i)  of paragraph (b) of subdivision 5 of section
 4310 of the public health law, as amended by chapter 40 of the  laws  of
 2016, is amended to read as follows:
   (i)  Where  required  by  law  for  [registration  forms] TRANSACTIONS
 described in subparagraphs (i), (ii) [and], (iv), (VII),  (VIII),  (IX),
 (X)  AND  (XI)  of  paragraph  (a) of this subdivision, the commissioner
 shall ensure, IN CONSULTATION WITH THE HEAD OF ANY  AGENCY  REQUIRED  TO
 IMPLEMENT SUCH TRANSACTION, that space is provided on any [registration]
 REQUIRED  form so that the applicant shall register or decline registra-
 tion in the donate life registry for organ,  eye  and  tissue  donations
 under this section and that the following is stated on the form in clear
 and conspicuous type:
   "You  must  fill out the following section: Would you like to be added
 to the Donate Life Registry? Check box for 'yes'  or  'skip  this  ques-
 tion'."
   § 3. This act shall take effect on the one hundred eightieth day after
 it  shall  have  become a law; provided, however, that if chapter 149 of
 the laws of 2020 shall not have taken effect on or before such date then
 this act shall take effect on the same date and in the  same  manner  as
 such chapter of the laws of 2020, takes effect.
