 Introduced  by Sen. KAVANAGH -- read twice and ordered printed, and when
   printed to be committed to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   requiring  local  solid  waste  management  plans  to allow composting
   facilities to operate in public recreational areas located in  a  city
   with a population of one million or more
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subparagraphs (vi) and (vii) of paragraph (b)  of  subdivi-
 sion  1  of  section  27-0107  of the environmental conservation law, as
 added by chapter 70 of the laws of 1988, are amended and a new  subpara-
 graph (viii) is added to read as follows:
   (vi) describe the participation in the preparation of the plan of each
 municipality which has chosen to participate in such preparation; [and]
   (vii)  describe  (A) measures undertaken by the municipalities partic-
 ipating in the planning unit  to  secure  participation  of  neighboring
 jurisdictions, (B) the limitations, if any, imposed by the proposed plan
 on  solid  waste  management  alternatives available to such neighboring
 jurisdictions, and (C) alternatives which would be available if a  local
 solid  waste management plan including such jurisdictions were prepared.
 Specific written suggestions  received  from  neighboring  jurisdictions
 shall be summarized and reflected in the plan; AND
   (VIII)  IN A CITY WITH A POPULATION OF ONE MILLION OR MORE, A PLAN FOR
 ALLOWING COMPOSTING FACILITIES FOR THE PURPOSE OF  COMMUNITY  COMPOSTING
 REGISTERED  WITH  THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION TO ENGAGE
 IN THE COMPOSTING OF WASTE IN PUBLIC RECREATIONAL AREAS SUCH  AS  PARKS,
 ZOOS  AND  BOTANICAL GARDENS LOCATED WITHIN SUCH CITIES. SUCH PLAN SHALL
 ALLOW SUCH COMPOSTING FACILITIES TO OPERATE IN SUCH PUBLIC  RECREATIONAL
 AREAS  WITHOUT VIOLATING ANY LAWS OR RESTRICTIONS RELATING TO THE ALIEN-
 ATION OF PARKLANDS.
   § 2. This act shall take effect immediately.

   authorizing certain community composting operations in a city  with  a
   population  of  one million or more to use parklands without violating
   alienation laws or restrictions
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The environmental conservation law is amended by adding a
 new section 27-0111 to read as follows:
 § 27-0111. COMPOST FACILITIES IN CITIES WITH A POPULATION OF ONE MILLION
              OR MORE.
   IN CITIES WITH A POPULATION OF ONE MILLION OR  MORE,  COMMUNITY  SCALE
 COMPOST  OPERATIONS  REQUIRING REGISTRATION WITH, BUT NOT A PERMIT FROM,
 THE DEPARTMENT SHALL BE PERMITTED TO OPERATE IN  PARKLANDS  WITHIN  SUCH
 CITIES  AND SHALL NOT BE IN VIOLATION OF ANY LAWS OR RESTRICTIONS RELAT-
 ING TO THE ALIENATION OF SUCH PARKLANDS.
   § 2. This act shall take effect immediately.

 NOT REQUIRING A PERMIT FROM THE DEPARTMENT, AND APPROVED BY ANY  COUNTY,
 CITY,  TOWN,  OR VILLAGE FOR OPERATION ON PARKLAND OWNED BY SUCH COUNTY,
 CITY, TOWN, OR VILLAGE, SHALL NOT  BE  DEEMED  TO  BE  IN  VIOLATION  OF
 RESTRICTIONS RELATING TO THE ALIENATION OF PARKLAND IMPOSED BY STATE LAW
 OR  COMMON  LAW AND SHALL NOT REQUIRE THE EXPRESS AUTHORITY OF AN ACT OF
 THE LEGISLATURE.

 CITY, TOWN, OR VILLAGE FOR OPERATION ON PARKLAND OWNED BY  SUCH  COUNTY,
 CITY,  TOWN,  OR VILLAGE, DOES NOT CONSTITUTE AN ALIENATION OF PARKLAND,
 AND SHALL NOT REQUIRE THE EXPRESS AUTHORITY OF AN ACT  OF  THE  LEGISLA-
 TURE.
