BILL NUMBER: S6959 SPONSOR: COONEY TITLE OF BILL: An act in relation to certain credits for any future application for a license to sell alcohol at retail for on-premises consumption SUMMARY OF SPECIFIC PROVISIONS: Section 1 requires the State Liquor Authority to state liquor to provide, upon application, a credit to any covered entity to be used towards any future application for a license to sell alcohol at retail for on-premises consumption. Such credit shall be in the amount that such covered entity paid for similar licenses in the year two thousand twenty. For purposes of this section, "covered entity" shall mean any sports or cultural organization that held more than one license to sell alcohol at retail for on-premises consumption in the year two thousand twenty. Section 2 sets forth the effective date.

COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT in relation to certain credits for any future application for a license to sell alcohol at retail for on-premises consumption THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contra- ry, the state liquor authority shall provide, upon application, a credit to any covered entity to be used towards any future application for a license to sell alcohol at retail for on-premises consumption. Such credit shall be in the amount that such covered entity paid for similar licenses in the year two thousand twenty. For purposes of this section, "covered entity" shall mean any sports or cultural organization that held more than one license to sell alcohol at retail for on-premises consumption in the year two thousand twenty. § 2. For purposes of this section, "covered entity" shall mean any sports or cultural organization that held more than one license to sell alcohol at retail for on-premises consumption in the year two thousand twenty. No cost or fees shall be charged to a covered entity for such credit.

Such one-time credit shall only be authorized to apply to license fees related to renewals or applica- tions to sell alcoholic beverages in the same locations for which the covered entity obtained a retail license for on-premises consumption in calendar year two thousand twenty. For purposes of this section, "covered entity" shall mean any sports or cultural organization that held more than one license to sell alcohol at retail for on-premises consumption in calendar year two thousand twenty. Such credits shall be given at no cost to a covered entity and no late fees shall be charged to a covered entity for such credit; however, if requested by the state liquor authority, such covered entity shall still be required to submit any forms or information to the state liquor authority to receive such credit. However, no credit shall be issued or applied pursuant to this section if such covered entity is able to claim a credit for such fees pursuant to any other applicable provision of law. § 2. This act shall take effect immediately and shall expire and be deemed repealed one year after such effective date. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
