BILL NUMBER: S6990 SPONSOR: BROUK TITLE OF BILL: An act to amend subpart A of part BB of chapter 56 of the laws of 2021, constituting the COVID-19 emergency rental assistance program act of 2021, in relation to incorporating provisions of the COVID-19 emergency rental assistance program of 2021 into municipal corporation emergency rental assistance programs PURPOSE: This bill would authorize municipal corporations, as defined paragraph 6 of § 2 of the COVID-19 Emergency Rental Assistance Program of 2021 (CERAP), to incorporate certain enforcement provisions of CERAP into municipal emergency rental assistance programs. BROUK -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend subpart A of part BB of chapter 56 of the laws of 2021, constituting the COVID-19 emergency rental assistance program act of 2021, in relation to incorporating provisions of the COVID-19 emergen- cy rental assistance program of 2021 into municipal corporation emer- gency rental assistance programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subpart A of part BB of chapter 56 of the laws of 2021, constituting the COVID-19 emergency rental assistance program act of 2021, is amended by adding a new section 15 to read as follows: § 15. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, A MUNICI- PAL CORPORATION, AS DEFINED IN SUBDIVISION 6 OF SECTION TWO OF THIS ACT, BY ITS CHIEF EXECUTIVE OFFICER MAY INCORPORATE THE PROVISIONS OF SECTION 8, 9, 10 OR 11 OF THIS ACT INTO SUCH MUNICIPAL CORPORATION'S EMERGENCY RENTAL ASSISTANCE PROGRAM. SUCH INCORPORATED PROVISIONS SHALL BE ENFORCEABLE IN THE SAME MANNER AND THE SAME EXTENT AS THE PROVISIONS OF THIS ACT. REFERENCES TO THE "COMMISSIONER" IN ANY OF SUCH SECTIONS SHALL BE DEEMED TO BE REFERENCES TO THE CHIEF EXECUTIVE OFFICER OF A MUNICIPAL CORPORATION OPERATING A MUNICIPAL CORPORATION SPONSORED EMERGENCY RENTAL ASSISTANCE PROGRAM. § 2. This act shall take effect immediately; provided, however, that the amendments to subpart A of part BB of chapter 56 of the laws of 2021 made by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith.
