TITLE OF BILL:

An act to amend the public health law, in relation to telehealth deliv-
ery of services by physical therapy and occupational therapy assistants,
chiropractors and mental health practitioners

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill will allow certified physical therapist assistants, licensed
occupational therapy assistants, licensed chiropractors and licensed
mental health practitioners to provide services via telehealth

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 of the bill amends paragraphs (1) and (m) (x) and (y) and adds
a new (z) to subdivision 2 of section 2999-cc of the public health law
adding physical therapist assistant, occupational therapy assistant,
chiropractors and mental health practitioners to the list of telehealth

providers.

Section 2 is the effective date of the bill.

 
JUSTIFICATION:

Physical therapist assistants, PTAs, are certified practitioners who
provide physical therapy services under the supervision of a licensed
physical therapist. Occupational therapy assistants, OTAs, are licensed
practitioners who provide occupational therapy and client related
services under the direction and supervision of an occupational thera-
pist or licensed physician. Chiropractors are licensed professionals who
detect and correct structural imbalance, distortion or subluxations in
the human body. Chiropractic services via telehealth have increased
during the COVID-19 pandemic and can include follow-up examinations,
risk assessments, range of motion and other visual assessments, patient
monitoring and instructions for spinal care.

Mental Health Practitioners are licensed psychoanalysts, mental health
counselors, marriage and family therapists and creative arts therapists.
Need for these mental health services has dramatically increased during
the COVID-19 pandemic and the ability to access these services via tele-
health means more people in need will receive the care they need.

Each of these professions are integral members of a patient's care team
and have been providing services to their patients via telehealth
throughout the COVID-19 pandemic. Adding them to the telehealth provider
list in statute will enable them to continue to provide services via
telehealth beyond the public health emergency period, enabling consist-
ency in practice and continued benefits for patients.

 AN ACT to amend the public health law, in relation to telehealth  deliv-
   ery  of  services by physical therapy and occupational therapy assist-
   ants, chiropractors and mental health practitioners

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraphs  (l),  (m),  (x)  and  (y) of subdivision 2 of
 section 2999-cc of the public health law, paragraph (l) as  amended  and
 paragraph  (m)  as  added by chapter 454 of the laws of 2015, paragraphs
 (x) and (y) as amended by section 3 of part F of chapter 57 of the  laws
 of  2021,  are  amended  and  a  new  paragraph  (z) is added to read as
 follows:
   (l) a physical therapist licensed AND A PHYSICAL  THERAPIST  ASSISTANT
 CERTIFIED  pursuant  to  article one hundred thirty-six of the education
 law;
   (m) an occupational therapist AND AN  OCCUPATIONAL  THERAPY  ASSISTANT
 licensed pursuant to article one hundred fifty-six of the education law;
   (x)  certified  peer recovery advocate services providers certified by
 the commissioner of addiction services and supports pursuant to  section
 19.18-b  of  the  mental hygiene law, peer providers credentialed by the
 commissioner of addiction services and supports and peers  certified  or
 credentialed by the office of mental health; [and]
   (y) A CHIROPRACTOR LICENSED PURSUANT TO ARTICLE ONE HUNDRED THIRTY-TWO
 OF THE EDUCATION LAW;
   (Z)  A  MENTAL  HEALTH  PRACTITIONER  LICENSED PURSUANT TO ARTICLE ONE
 HUNDRED SIXTY-THREE OF THE EDUCATION LAW; AND
   (AA) any other provider as determined by the commissioner pursuant  to
 regulation or, in consultation with the commissioner, by the commission-
 er  of  the  office  of mental health, the commissioner of the office of

 addiction services and supports, or the commissioner of the  office  for
 people with developmental disabilities pursuant to regulation.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
